By the way, why is YOUR insurance involved? If the other party is at fault, normally (at least in the US) the other party’s insurance should handle everything.
Even in the US there's a lot of good reasons to go through your insurance. Your insurance is the one contracted to work in your interest; the other party's is not.

In this case with multiple vehicles involved? Go through your own 100% instead of waiting for the other parties' insurances to figure out faults, limits, percentages.

Well, the other party’s insurance is typically very interested in limiting their amount of exposure, so they are absolutely motivated to keep you out of the hospital, and stay out of court. In my experience that manifests in customer service that is better than my own insurance company’s. What’s really sad is I totally understand why that is.

As far as multiple parties, if there is a police report, it all points back to the at-fault individual. In my wreck, the guy I was pushed into said he had somewhere to be, and was I cool, and I was like “cool.” Never saw him again. 😂

I don't know if you have it in Canada, but here in the States we do depending on the state it's called diminished value.

Since it was the other party's fault, I'd be going after their insurance for the diminished value on your truck, which should be substantial.

That really sucks. That's a shitty way to ruin a good weekend. Sadly no matter where you go nowadays everybody drives like shit and doesn't look out for one another, it's every man for himself. They're in such a big hurry to get to the next the light or intersection.
I was going to say that myself—diminished value is a very real consequence and well known here in the USA. I would get an attorney to write a letter and certainly get several more Collision estimates. There is no way it is worth $21,000 in any currency to fix a Maverick. I wish you good luck.

Police reports don't determine fault; unless they saw it themselves it's just documentation of heresay. The other party's insurance can limit their exposure by coming up with any pretenses to rate less than 100% liability (if it's a state with comparative negligence). Hypothetically in OP's case they could attempt to claim that they were following too close to the vehicle ahead or else they wouldn't have been pushed into them. For a more practical example I had someone attempt a right turn in front of me from the inside lane; liable's insurance tried to rate only 90% because "I could have braked harder" (despite dashcam with the tires audibly at threshold). Coincidentally that insurance company is now out of business.

exactly - somehow Carfax gets a hold of the damage and the repair costs and then these are used to show the 'value' of your fixed ride - I've seen other posts where owners have pursued diminished value and their insurance companies have ponied up for the difference.

Just speaking from recent past experience with an accident and its police report. The DCSO officer wrote "Driver 3 (the one who rear-ended me) failed to control his speed." Like with OP, it was pretty obvious. I don't know if they were actually cited. I’m sure it varies. 🤷‍♂️

Seems like Canadian procedures are different anyway.

Keep in mind the OP's numbers are in CND and the cost of our trucks even with exchange were inflated slightly (because they could). MSRP on my 24 Lariat with BAP was $49k CND (approx. $35.7k USD at current rates).

Sitting at $21k US in damages right now and currently being rebuilt. $5k for the door and fender and $16k for the tree damage (hood, roof, body side and tailgate). I really don't worry about "diminished value" because I keep my vehicles until I junk them. Don't depend on cheap insurance and you'll be OK.

It was July 21, I was on my way with my pop up camper to the camping site to meet my brother and some friends for a whole week of holiday in great company. Unfortunately I never made it. About Half way there when the traffic slow down because of roadwork, the car behind me never brake, hit me in the trailer and push me in the minivan in front of me, then hit me a second time. Results: camper is totalled, maverick have at least 21 000$ in damage (in Canadian money) and my holiday are ruined.

With these damage and all the thread about rear ended mavericks being totalled, I was sure mine will be also and I started to tell to myself it was the best time to order a 2025. Until my insurance said nope, we are fixing it. All that I learned is that they asked the body shop to check some precise parts and they were undamaged so they will fit it.

am I the only one to think that repair of that value will cause a big value loss? I am now waiting for soon 2 months, they told me 1 part ordered is still back order

I am so sorry your trip turned into a nightmare. At least the humans are ok. Can you get a second opinion as to the extent of damage? Also, I assume your insurance will pay for a loan car during the repair which will take two months? Are they factoring that cost into the claim?

For what its worth, I learned that when traffic in front of me slows suddently, I hit my flashers to alert the driver behind me. That gets their attention in a way brake lights alone don't.

as mentioned in a previous post make sure you get a diminished value payout. Your title will now show an accident and it will show up on carfax report. It should be in the thousands. If it's properly repaired and your keeping it it's not such a big deal but if you were planning to sell it in a few years it is a BIG deal to you in CAD. good luck

My last insurance renewal invoice from State Farm included an insert with policy amendments. The main thing I seem to recall is that they get to choose which of several cost estimate methods will be used to determine damages. One of the listed methods is (of course) their own estimate. I also recall seeing that a loss of value after repairs is not covered. Over all the years I've been paying for insurance, I think I would have been FAR ahead by being self-insured...

That’s the things here in canada(at least in Quebec province), insurance take the decisions, they are suppose to at least talk to you to get your opinion but most of the time they don’t even bother to do it. But I know this garage and I know they will do good work. And yes I got a rav4 as loan for all the time of the repair. It’s not my maverick but it’s only temporary.
