Your insurance will cover damage that occurred while you were driving someone else's vehicle.
So, yes, you can claim.
A dealer always copies your license before letting you test drive, but I've never had one ask me to prove that I had insurance. I don't know who typically pays for test drive damage.
Ford has to insure for test drive, and they are covered, thats why they have to prove they let a licensed driver test it. If you intend to keep it forever, insist on a new one. This one will rust where it was hit, no fixing bent metal.

After waiting 11 months and 1 day, my Maverick Hybrid XLT was ready for me. It was beautiful, had 3.4 miles on it. The salesman suggested I take it for a drive while he finished getting the paperwork together. My wife and I went down the nearby freeway to the next exit and turned around to come back to the dealership. I stopped at a yield sign on the service road (less than 1/2 mile from dealership) and was rear ended by a kid in a jeep. Bumper, tailgate and bed wrinkled. Fortunately the kid has insurance. So the Maverick I ordered is in the body shop with 8 miles on it.

But here is where I need advice from this forum... I haven't signed anything yet to take possession. So I thought the dealer would pursue the insurance claim, but they think I should do this since it is my order. Can I even collect insurance for repairs on a car that was not titled to me? Should I be paying full MSRP on a car that has been in an accident and the trade-in value is diminished? Or should I wait until after it is repaired and test drive it again before taking it?

Thing that sucks is this truck will always show an accident on carfax and be worth less at resale

It doesn't look like your plates were on the vehicle so my Guess is your insurance will not be involved and obviously you were hit in the rear so the guy that hit you is responsible. But none of that's important, I would take the truck or wait a year for another? the repair is straight forward a new bumper and lid, only repair is the bed and rear body, and any repair shop can repair that 99% the key is the repair shop.

Until you sign the paperwork it is the dealer's truck and is covered by his Ford floorplan insurance/garage owners liability policies. My advice- walk away now and re-order you a new one! If it is not tiotled to you, it is not your vehicle.

I'm not a lawyer. The truck belongs to the dealership. Why should you pay for repairs?

Would they expect you to pay for repairs if it was damaged coming off the truck?

What about if it was damaged by hail the morning before you went to pick it up?

Makes no sense.

Okay I'm not an expert or anything but I did stay at a Holiday Inn Express last night and I was an insurance adjuster for 40 years. Several things are in play. Was this a "retail" purchase from Ford? If so your name is attached to it and any promisory contract was signed, with down payments and such, make it your vehicle. If you have insurance it will likely cover any vehicle of "yours" for thirty days while the Ins co waits for the paperwork to catch up. However (this can differ from state to state) the physical damage to your auto may require that it is a titled vehicle to you or at least the paperwork is in the mail. Call your ins agent and have them call you ins co's underwriting department for a definitive answer. If you want to keep, get the Jeep owner's ins co agree to replace the bumper cover and any damaged substructure (rebar and impact absorbers et al), new tail gate and emblems, new box complete...NO REPAIRS! This way it is put back to completely undamaged condition and you should have no diminished value claim. You will have to wait for parts but hopefully not another 11 months. Like we say, some of this varies from state to state. Good luck to you sir.

Totally sucks... I ordered mine from Trenary in Moscow Mills on my birthday back in January. No build date yet. My wife was rear ended by a kid in a camaro, 2 months ago. She was driving our Nissan Rogue. Behlmann in Troy did the repairs from his insurance.

No lawyer, but I would walk away... if your insurance pays, your rates will go up for years to come even the Jeep kids insurance pays. Let the dealer deal with this; lifes to short.

That was a loooong thread to get through and I still don't see an update!
Not complaining to the owner of the thread, just making a light hearty joke.

From what I'm getting, HiHo Silver, was not at fault, and as long as his insurance doesn't have to pull in any lawyers, appraisers etc. his rates should not go up, but we all know how that plays out.

I found it interesting the possibility, the dealer might not have to report it was in an accident, but I wonder on any 'full disclosure" laws if the dealer sells it as new?

Good luck on your decision, with the way supplies are currently, there is definitely not a clear decision on this. Too bad it's a uni-body, not body on frame, makes the repairs a little less painful.

Sad to hear, but you should check with your insurance before taking advice. You may, or may not, be covered. Look at it from dealer viewpoint as well - if you don't take it they'll certainly come after someone for damages and you're the driver. It applies same as if you're tests driving any other vehicle. Personally, mine will be covered from when I get the VIN. Already saw to that. Best wishes with it though

As you said, the other driver had insurance. Your insurance company will sue his insurance company and nothing against you. Just make sure it is straight before taking delivery.

The dealer doesn't report it as an accident.....
It will probably depend on whether or not there is an insurance claim or not. If there is (and certainly looks like this should go on the the kid who hit the Maverick's insurance), this will probably be pulled onto a car fax report.

If there is transportation damage or damage on the dealer's lot that is taken care of internally, then there will be no report to carfax, because insurance wasn't involved.

Every state has difference laws as to how much damage is required to be disclosed to the buyer. Some states have a set $ amount. For others it is % of MSRP. Some high, some low. So it really just depends on the total bill for fixing the damage and the state laws where the dealership is.
