My ‘23 XL does not have Copilot 360 and I assure you it does have AEB.I see XLT wheels on that Maverick which leads me to believe it did not have Adaptive Cruise Control and it may or may not have copilot 360.
If it doesn't have CP360, no automatic emergency braking (AEB).
if it has CP360 but not ACC, it only uses the forward facing camera (that's also used for lane keeping assist) and it needs visual cues to trigger AEB. it can trigger on vehicles or pedestrians.
if it has CP360 and ACC, it would use radar and the forward facing camera both to use visual cues and radar distance & approach speed to trigger AEB.
AEB can be disabled in the driver's instrument panel menu.
Absolutely, we avoid I-35 like the plague when going to SA.Area under construction or just before that area. It was confusing enough prior to building the upper deck.

No, regarding AEB.I am very confused about the capabilities of different trim models. I have an XL with cp360, it definitely has assist, where it flashes red, but I don’t think it has auto emergency braking. I’ve tested it out by playing chicken with stopped cars before and it never brakes, I always give in last second and slam on my brakes myself.. I definitly don’t have ACC and I think the system needs ACC to be able to emergency brake and emergency swerve maneuver. Is this true ?
