What’s the latest on fighting Market Adjustment

Just got notification my 23 is built. Last year when I got my 22 from Jim Hudson Ford in Columbia, SC they didn’t get me for any extra money.

I have recently been talking to a friend that has one on order and they told him they are doing a market adjustment on all orders. The lariat was $7500 adjustment. They say it’s different for every trim.

does anyone know what the latest is on Ford withholding allocations etc.? I want to get in front of it so they don’t pull the pressure me crap the day of.

thanks for your help. I haven’t been on top of MTC as much as I was last year, to know the latest and greatest.

Nothing has changed. You are price protected to your order date, and your dealer SHOULD honor MSRP pricing from your order date, as clearly listed on your order sheet.

It's really no more complicated than that. You are price protected. You know. They know it. Ford knows it.

Now, can you FORCE them to be reputable, reasonable businesspeople? No, you can't. If they insist on charging you an extra however many thousand to get the truck YOU ORDERED at a previously AGREED UPON price, then it is what it is.

That said, I would not go down without a fight. Make a scene, have a yelling match with the general manager if necessary and call Ford customer service to report them. I have seen other people on these forums use these tactics to get dealers to back down and do what they should have done all along -- honor the retail order at RETAIL pricing.

And, if that doesn't work, share the dealer's name here when the truck shows up and they are giving you a hassle. I have seen other dealers relent after getting multiple 1-star Google reviews and phone calls from fellow forum members who want to know why the dealership won't honor its retail orders and treat its customers with respect and fairness.

Sad that things have to come to this in today's world, but like I said, it is what it is. Hopefully, your dealer doesn't try and stupid games when your truck shows up. Just be prepared to fight fire with fire if they do.

What price was agreed to when you ordered and both you and the dealer signed the order/sales agreement?

Got my 23 Lariat hybrid at msrp, zero add ons from Jim Hudson Ford 22 April. No market adjustment.

Ryan, check with your atty but IMO basic business law tells me the dealer's offer (Order Form) + your acceptance (DL# submitted to Ford) = Contract.

I think your dealer would have a hard time explaining to a judge why holding your truck hostage, in an attempt to get more money than the price you agreed to order it at, is not a form of extortion.

Most of the order forms say that final price is subject to the sales contract. To be protected buyer really needs a sales contract with OTD price signed both sides.

This isn't going to be a court issue. It's about appealing to their business sense. Even if OP was able to win the case in court, it would already be sold and OP would be out the truck. Maybe if you could signed under duress and try to recover extra later, but I doubt they give you the truck under those terms.

Since the OP hasn’t responded to my question #3 in a week it appears this is another case of someone ‘ordering’ a vehicle without some sort of dual-signed purchase agreement stating the sales price.

Take a look, the Mav order forms do not say the price is subject to anything. If you expected a delivery from Amazon but the driver demanded $500 more in order to leave the package, would you assume that is right? Don't give up without talking to an atty. If the truck was sold, they would probably owe another at the same price.

So are you saying that a dealership buyer's order for a vehicle that states all costs and has a final out-the-door price listed that is signed and dated by both the customer and the General/Sales Manager of the dealership that has in writing that you the customer are obligated to purchase the vehicle at the stated price and that the dealership is also obligated to sell the vehicle to you at the stated price is not a valid contract.

That is news to me as many here on this forum have stated that it is a binding contract.

Dinner is an order at a restaurant. The owner cannot raise the menu price after they deliver the food, just like the owner of a dealership cannot raise the price of your Maverick ordered specifically for you under your DL# to some random number they feel like charging after your build gets delivered.

If it's really news to you that a buyer's order is not a binding contract then you need to learn a little more about how this all works. It's not a binding contract. The dealership is NOT obligated to do anything, nor are YOU.

This is why people are able to walk away from their orders at any point without penalty - NOT a contract.

It is why many dealers add on other things when the vehicle arrives such as various fees, packages, accessories, tax etc.

It's why Ford doesn't care whether your buyers order is ever allocated to the dealership or built. If it were a binding contract there would be multiple lawsuits right now from 2022 order customer demanding their trucks be delivered. Not happening is it?

You cannot take a buyers order to court and demand a dealership honor it. Try it and let the rest of the world know how that works out.
