your insurance paid the claim? I would be wanting the at fault party's insurance to be the one paying. And include rental until you can replace it?
They other insurance accepted full responsibility.
I got a rental for the time the claim was going through, fully paid for.
I then got paid.
I'm sure the two insurance companies will figure out where the money is coming from.
Not my problem.
My insurance said they will not raise my rates because they were 100% at fault.

That sucks , and dang you already have a build date. mine was ordered 17 Sept 2022 and I just got another email saying it’s not being built

Yeah, my dealership is pretty good, but I also made sure I didn't order anything "Constrained". Not sure about your situation though. Hope you get a build date soon.

It is by design, to absorb the energy of the crash and protect the occupants, not the vehicle.

15 years ago when you had your crash, apparently your vehicle wasn't designed as well as new ones are, WRT occupant safety.
This is true, the OP took a very hard hit, I have never seen one on this site that bent the floor of the box like that. But Mavericks are being totaled for minor hits & that is something that needs to be addressed with either more replaceable parts in the rear frame section or a crumple zone that can be replaced. Otherwise insurance is going become a problem for all of us.

that's good to hear.............hate that happened to you but glad you're ok. I'd have stripped off every small little part I could before handing it over to the junk yard or whomever has it now.

LOL, yeah, I thought about that, but I'm sure that would have pissed off somebody. CoPart has it, I'm not sure how they operate, but I think they buy it from the insurance company and sell they parts for profit.

Actually, the way OP's insurance company is handling the claim sounds appropriate. I would venture to say OP's insurance company is paying as a "collision" claim ... Collision coverage protects the owner of the vehicle ... the loss is paid regardless of fault. The insurance company will then subrogate (make a claim) against the insurance company for the "at-fault" party as a "liability" claim.

If there is no doubt whatsoever who is at fault, the insurance company might go ahead and cover the deductible associated with a collision claim. The OP's insurance company might also pay for a rental vehicle as well and subrogate that expense back to the insurance company for the at-fault party.

Overall, the net effect is that the at-fault party's insurance company is paying the claim. There should be no affect on OP's insurance payment history or driving record.

The OP benefits through faster payout of the claim with minimal to no out-of-pocket expenses. If OP does incur some expense and OP's insurance company successfully subrogates for that expense, it should reimburse OP.

With most reputable insurance companies, the overall payement and subrogation process is rarely an issue for property damage claims as it is fairly easy to determine the damage and related expenses.

Once the insurance company totals a car, it owns it - payment for the loss transfers the title to the insurance company as part of the claim process.

The insurance company technically could demand that the original owner return parts taken off the vehicle. Whether it does that or not is probably handled on a case-by-case basis - does anyone even notice?
