Can a new 2026 Maverick be purchased with a pending recall (parking brake, etc.) present? I understand that delivery cannot take place.

I just had a dealer who stated they could not move forward with the purchasing paperwork due to the open recall.

I think it depends on the dealer. No dealer is supposed to let you pick it up but alot of them won't sell them when there is that type of recall that says they can't deliver it.

Federal law says a NEW vehicle cannot be sold with an open recall on it. Your dealer is correct.

I had a salesman tell me until they wrap red tape around the vehicle they will roll them off the lot!... Don't ask me how I know!

Federal law clearly prohibits dealerships from selling new vehicles with open safety recalls. Under 49 U.S.C. § 30112, franchised dealers cannot sell, offer for sale, or deliver any new vehicle with a known safety defect or open recall.

As a matter of fact. Car rental companies are prohibited from renting vehicles that have open recalls per
Houck vs. Enterprise. Case law

I don't know why an Owner or General Manager would risk their multi million dollar dealership and franchise selling /delivering a vehicle that's under recall.
It doesn't make sense.🤷‍♂️

Be glad they did follow the law.

Prior situation like this had the sales happening before the recall came out as apparently a total surprise. Or they knew and tried to squeeze them in.

So plenty of complaints here of purchase on Fri - unable to pickup after dealer prep on Mon.
Special orders or off the lot.
For months unable to pickup.

Nothing like sitting in sales office trying to understand why you can't take it - as you watch out the window and a Lariat being rolled out after just being sold with pictures and balloons and confetti ect going on, smiles on all the faces.

Yes, but don't do it. I bought an Explorer and it sat on the dealership for six months before I could bring it home. I couldn't even have them buy it back because according to state law, it became used the moment my name when on the title.

Lesson learned. I only buy things I can drive off the lot that day.

A lot of dealers require a deposit when you order a truck. Sometimes refundable and sometimes not. The purchase does not take place until the vehicle arrives, and you "buy" it. If you want this vehicle and are willing to wait, ask the dealer if he will take a deposit for right of purchase when the recall comes off. Just a thought...............

Agreed,
And that's exactly why smart dealers won't start the sales process at all, on a vehicle with a recall. Can't even take it for a test drive.
Ordering with a deposit is a totally different.

And that's what my dealership did. I drove a line of F-150s for the 6 month period. Took an F-150 Lariat to the beach because the Explorer wasn't ready. All to get rid of it anyway because we filled it to the gills on trips. We've yet to pull that off with the Expedition Max my wife upgraded to.

But yeah, no buy unless you can drive.

My local dealer wouldn’t sell me a ‘24 model a year ago because of the rear view camera/display issue on an XLT.
There were dealers who sold them — but “play the tape” — that’s only going to create livid impatient customers lol.

No but the recall is available for the 2026 models. Dealer can complete it in 30 minutes so you can take it home after purchase.
