I had to sign one when placing one of my 2023 orders. 1 year agreement not to sell unless it's back to the dealer.
So they asked you to sign it at the time you placed your order. That's more fair than when you are about to pick up your Maverick. At least you knew going in what the deal was and could decide if you wanted to move forward with that dealer.

Add these clowns to the "shitty dealers" list the forum has. Absolute ridiculous

Correct. This was more tolerable than dealers charging more than MSRP at the time of ordering. 3 of the 6 dealers I contacted wanted over MSRP when the order banks opened.

Great answer. You are my kind of lawyer - straight and to the point.
I appreciate the input but figure some specifics on why it wouldn't be legal in CA would help. But I could see CA being a state to squash it.

See the comment just before your reply. It appears Ford has won this type of restriction in court before. I like the idea, as too many of the Mavericks have been purchased with sole intent to flip. I would prefer those who ordered be people who actually want to own one.
I don't think Ford won. If you're referring to the John Cena instance it settled out of court.

It's a friggin Maverick. It's not like you're John Cena trying to flip a limited edition GT too soon. Dealers are the worst.
Exactly. There is enough here to think it is potentially enforceable (again state dependent). But to your point I doubt any dealer is going to go through that nightmare for a couple K. It's a scare tactic.

For the person who asked to see the back of the form, I've attached it here.

Note that it says"
"Customer is entering this agreement voluntarily, without coercion or intimidation of any kind, and that Customer has sought legal advice before executing this Agreement or has elected not to seek such advice."

Not so "voluntarily" since they wouldn't give him the Maverick if he didn't sign it!

I wonder how "its market value" is determined.

If it were me, I’d buy it anyway, then bring it back to the dealer in a “temporarily undesirable” state. Motivate them to sign off their so-called right to purchase it. Then undo the ugly! The sky is the limit on what “temporary” could mean (find a horrible set of wheels, bald tires etc…)

Not a lawyer, But bet this would not stand up in court. Its kind of like when you get the extra $1000.00 rebate when financing the vehicle thru ford credit the dealer says you cannot refinance until after the first payment. . . .
Prepayment penalties are very common.

My friend picked up his '23 rolled over '22 Maverick today and was told he must sign a Resale Restrictions Form to get the truck he ordered. I didn't when I picked up my '22. Has anyone else experienced the same this year?

The restriction is he can't sell for a year, and if he does and gets over MSRP he must give that extra $$ back to the dealer. And he must give 30 days notice to the dealer if he decides to sell before the year is up, and the dealer has first right of refusal to purchase it.

I've heard of a similar restriction on popular vehicles, but not on the Maverick until now. I've attached a redacted copy of the document he had to sign.
So who's going to tell dealer that the truck has been sold? Are they going to get access to the secretary of state's records and then bring in the dealer police and file lawsuits (costing thousands) just so you will 'get your mind straight'? No, it's not enforceable and just some scare tactic.

Just tell them that it is sold, get to court and then waste all their time and explain that it was not sold and ask for compensation due to lost work and fees.

Punishment for consumers not dealers. Great way to keep customers Ford. Any manufacturer doing this will down the road face massive lawsuits. GM with z06 is doing the same.

I'm surprised that they haven't gone to warranty time reduction like the RV I bought (section attached). The first owner gets a 2 year manufacturer's warranty, but the warranty is reduced to only one year from original purchase date if sold to a second owner, and all warranty disappears if there is a third owner. That would discourage quick resales, but not make the dealer any extra money.

Yes if written into the contract, What I am talking about is the dealer saying verbally you have to wait until after the first payment. They tell you this because if you do not wait until after the first payment they do not get thier payment from ford motor credit for doing the finance. I have bought a new Ford F-150 everythree years for the last 15 years, I usually take the ford credit to get the $1000.00 or more rebate and then turn around the next day after finalizinh everything and refinance at my credit union for a lower rate.

They should have made you agree to this when you ordered, not after it arrived. Unbelievable how greedy some of these dealers are. I bought mine 13 months ago, several hundred UNDER MSRP and my dealer didn’t do any kind of crap like this.
