My wife was in a 10 car pile up on an icy highway 2 years ago. Out of the 10 cars 5 had current insurance. According to our insurance company.
This why I always ensure I have very good coverage and underinsured driver protection. It took over two years to get from accident to settlement when I was t-boned. It went to arbitration so there were 3 rooms rented. Me and my lawyer, the insurance company lawyer and the other driver and his lawyer - the arbitrator moved from room to room. We had the same insurance company and because his coverage was deemed insufficient given my expected settlement amount, he had to hire a lawyer (the insurance company lawyer could not represent him completely) and he was on the hook for anything over his coverage (it probably cost him a lot more than paying for decent coverage from right from the start.

My one month old Lariat. No kidding. February 19th purchased and March 21st hit by a guy without breaks. Airbags deployed, windows and doors unlocked, and the truck called 911 immediately! I was so impressed that I said “wow” while on my side. Thankfully, everyone was okay. I’m just so impressed with the safety of this truck.

Outta curiousity, what mechanism called the police automatically? Was that the truck or your phone or your watch or what? Feel like I need that.
On the Transits I drove there was a 911-assist option in the radio menu, and it would show a little star of life in the corner of the screen when enabled.

Some insurance companies only allow for "new vehicle replacement" if you have a rider like Allstate's "Auto Replacement Protection" which costs us an additional $9.15 on our 6-month policy.

With the cost of new vehicles continuing to rise yearly for us it is well worth the cost.

In the event of a covered total loss due to physical damage to the auto to which Auto Replacement Protection applies, we will pay to replace that auto.

It's VERY common to feel the effects of a major injury hours or days after the fact for something like a vehicle accident. The swelling and inflammation can take that time to develop, and the adrenaline takes longer than you think to wear off.
Confirmed. I used to work at the Watkins Glen track on weekends. I've seen a guy with a visibly broken leg walking around due to adrenaline.
We called it "Stupid juice".

That's terrible. I'm glad you're okay.
Thankfully you were doing well enough, to be walking around. I would still go see an Osteopath.
Lot of times problems don't crop up for a day or so.
I'm glad the truck did what it was supposed to do.
Out of curiosity how old was the other driver male/female?
I don't believe for one minute the brakes failed.



I'll bet the driver of the second car also claim that their brakes failed.
When my mother was 87 and driving safely, witnesses reported she successfully avoided a semi in the process of jack knifing on a local interstate. She drove into the median and back onto the roadway to avoid other cars.

Interestingly enough, three other drivers plowed into the truck she avoided.

That just covers bodily injury not vehicle damage, at least in my state.
UM is generally part of your liability, and what pays for bodily injury to you for un/under insured drivers. Depending on your state, you might be able to opt out of it. I've done this at times, when I had good health insurance and the UM portions actually higher than the liability portion!

Damage to your vehicle by an uninsured driver is covered by comp.


It's VERY common to feel the effects of a major injury hours or days after the fact for something like a vehicle accident.
To be clear, it's "soft tissue" injury that takes time to manifest.

I used to do a moderate amount of PI work as a lawyer. Possibly useful lessons from that:

1) best results came from treatment by an MD and physical therapist. Hot on the heels of that combo is by an Osteopath (A D.O. has both the medical training of an MD and can perform the manipulations of a chripracter--and knows enough medicine to know whether that's a good idea or not!). Chiropractors were not only a very distant third, but it was also more difficult to settle the case, and only for a lower amount.

2) soft tissue injury (muscular) tends to take 24-48 hours to really manifest. This is quite often the only injury in an accident. Roughly, you tense up, and start feeling it as you relax. If you stiffen in anticipation, you will be whipped about more violently (Physics sucks sometimes!), and have a worse injury, while if you're asleep (hopefully not driving!), you'll flop around more and be hurt less. Drunks come out best of all.

3) Do NOT get a lawyer with heavy advertising! The economics of that type of practice are different, and driven by settling quickly. Settling faster for less money means less overhead, or more cases per worker. The insurance companies tend to know the "number" of those practices, a multiplier of parts of the medical bill,, and uses it to offer a lower settlement. Ideally, find an attorney who does a lot of PI, but by referral rather than advertising.

Once, years ago, I thought I had a faker in my office, so I sent him to a particular DO that had an eye fore that, with a heads-up call as well. He was in my office within something like half an hour after the bus he was on was rear-ended by a car, and already supposedly in pain. As it turned out, the car hit the bus at about 60 mph, and he was rather low IQ, able to handle a menial job and taking a bus to it while living with his parents. He didn't have stress, and went to a lawyer because that was what he heard you were supposed to do after an accident. The lack of stress and tensing up meant that he felt the soft tissue injury immediately.


Mmmmm, you sure about that? If you have the option, might be time to "lawyer up" on this one.
