In Ohio, I believe 1 of the stipulations/triggers is 45 days for the same issue. Your vehicle just can't sit there while you can't drive it, they can't fix it, and you are making payments on it (or have paid for it in full).
Per Ohio Attorney General's website:

Has the manufacturer had a reasonable opportunity to repair the vehicle?
If you can answer “yes” to any of the following four questions, the manufacturer is presumed to have had a reasonable opportunity to repair your vehicle under Ohio law.

In the first year or first 18,000 miles, whichever occurs first:
  • Have three or more attempts been made to repair one problem and then the problem either continues to exist or occurs again?
  • Has the vehicle been in the shop for a cumulative total of 30 days or more during its first year or 18,000 miles, whichever occurs first?
  • Have eight or more attempts been made to fix different problems?
  • Has one unsuccessful attempt been made to fix a problem that could cause death or serious injury?
If you answered “yes” to at least one of these four questions, you have the legal right to ask the manufacturer to replace the lemon or refund the entire purchase price.

My truck has been at the dealer for exactly two months now. I had a check engine light. They thought it was the powertrain control module, but it ended up being the exhaust and muffler system. I filed a lemon law claim and Ford is repurchasing my truck. I’m so sad! I loved my truck.

Bummer! I hope you get to take all these after market parts off the truck??

"Full size spare, Tow hitch, Oxford White, WeatherTech hood deflector,Line-X SIBL, Truxedo Soft Roll up, OEM floor mats, front splash guards, tailgate assist, sunshade, tailgate letters, sill plates, window deflectors, cab spoiler".

it would be a shame to let these go back to the dealer for your Invoice price.

So the dealer will likely buy it back park it in the corner of the lot for a few weeks until the parts come in, then sell it at $5K over MSRP, right? Seems like a win for the dealer.
Ford is buying it back.

While I am sure there is probably some personal satisfaction in having it declared a lemon, wouldn't CarMax have given you more for it?

How much longer were exhaust parts going to take? Could have rented a car for a month and made more money in the end I think.
Exhaust parts might come late next month. I was hoping it would get fixed and I would get the most comprehensive ESP with my lemon claim.

This may vary by state, but in CA a vehicle is declared a lemon by the Manufacturer. Once Ford has paid out the customer under the lemon law the vehicle will get a Lemon Title.

It is up to Ford of how they dispose the vehicle, but the most common way is using a 3rd party who sends it to auction.

The dealer might be able to buy it, but most likely the won't as the Carfax and Title will now have a Lemon Buyback on it.

Maybe I’m missing something in all this, so in the end you filed a complaint for lemon law due to the exhaust system has to be completely replaced and being in the shop for 2 months waiting on parts delivery. You apparently added a host of aftermarket improvements that you more than likely won’t be compensated for along with purchasing something else. Just wondering if you’re coming out on top in all this, but then maybe with the frustration and dissatisfied that’s not a factor. In the end all that matters is your happy, wish you luck with everything

Sorry to hear about that. frustrating as can be. What are your remedies with Ford/Dealer under the law? I kinda agree with uga on where the lemon is. One of my bosses had a new 750 BMW. Was in the shop more than out. And the worst part was the. Klaus is the onlky one that can fix it and he will be back next week comments. Let us know the resolution.

Did the dealer provide a loaner? If so I'd rack up the miles on the loaner while waiting.
