I think it is important to note that you are mad at BRIGHTON Ford dealership, not the manufacturer.

If they called me and told me that I wouldn't have even driven over to the dealership. I would have told them to text me photos of the damage and to get it over to the body shop themselves.

Then I would keep the loaner and go about my business until the truck was fixed.

Never take something damaged like that back. NEVER.

Get a lawyer. If everything is as you described this is a slam dunk case for any competent lawyer. The dealership will probably make you an offer out of court to make you whole as soon as a lawyer is involved.

What I don't understand is why would you go pickup the truck?? That doesn't make sense. You keep the loaner until they get you a new truck. If they demanded the loaner back you say talk to my lawyer. They get the loaner back when you get a brand new truck...

Even if they do fix it completely, you have diminished damages. The truck will never be worth what it was. It will always show the truck was in a wreck and this will bring less money if you trade the vehicle or sell it out right.

I had a new Explorer wrecked many years ago and received a diminished value claim for my loss in addition to getting the vehicle fixed.

To say the least.

Let me get this straight -- and I'm paraphrasing.

A dealership takes a customers vehicle out on a test drive while it's in for service and is involved in an accident and then has the audacity to tell the customer that they have some "good news" and bad news?

Afterwards, the customer arrives to pick up his vehicle (what's left of it), and then the dealership sends him on his merry way in a vehicle that's unsafe like if it's just an every day occurrence?

Excuse my lack of compassion, but I'm still trying to make sense of this incident. I've heard stories of shady dealerships, but this is taking it to a whole nother stratosphere.
It would be nice if the op responded to this. I tend to agree that there are details missing. This is an extreme example with just enough details to make us all angry and respond as we are, but not enough details to fully understand what’s going on. Without further input from the op, I don’t believe the situation is as described.

So, I'm not really sure where to direct my frustrations. Maybe, people here can help me see a proper path to peace.

My 2022 Mav Hybrid XL had to be taken into the dealership (Brighton Ford in Brighton, Co.) where I originally purchased the vehicle as the powertrain failed at around 18k miles.

The vehicle was inspected and it was determined that the powertrain had faulty connectors and needed replaced. A common problem for the first year models.

Good news right?

So, while they were doing a final test drive the vehicle was rear ended, and hard. So hard the vehicle was pushed into a F-150 with a trailer hitch.

The dealership calls me and basically says "So, good news and bad news. We fixed the issue and your free to come pick up your truck and return the loaner, but your truck was involved in an accident and you need to have it taken to a body shop as we don't recommend driving it. But, it is drivable, and you can come pick it up and return the loaner."

So, I take my loaner back and they drive my truck around for me. Very serious damage front and back. I finally get a chance to take it in to a body shop for an estimate, and I've been told that the damage is so extensive they are amazed it's not wobbling as I drove it down the highway as the vehicle frame is twisted and bent. My radiator is demolished and I'm surprised I've not had issues with that, and you can feel the bend when standing inside the bed. Basically, my vehicle is totalled..

What really pisses me off is that if they total it our and refuse to repair the truck not only am I out of my beautiful blue truck, but I'm out a year of my life that I waited for my custom ordered truck, the $3k cash I put down, but also no vehicle on the market today comes with a 1.9% APR...if I have to buy a new vehicle I'm going to lose my shit and sit outside Brighton Ford and picket daily letting potential customers know that they will destroy your vehicle and leave you with the bill.

Anyway, I just needed to rant.

So, am I wrong for thinking that Ford should be making me whole? The dealership basically told me "It was not our fault so it's not our responsibility to return the vehicle in the condition it was received."

You made 3 mistakes - first you should not have accepted it and gotten in it and driven off the lot. 2nd you should have immediately while at dealership contacted your insurance to let their lawyers fight with Ford dealer’s insurance and lawyer’s, and 3rd you should have called the local police to report the accident whereby you would be entitled to information on who was driving it when it happened and their insurance could be involved as well. Good luck!

They had possession of the vehicle they are responsible; sue their ass.

It's not the dealer's fault. That is why we are required to carry insurance for the vehicle. When you sign the repair order it is one of those things in the small print that you are acknowledging, that the dealer is not responsible for damages that would be covered by your insurance. If it was the fault of one of their employees for the damage, they should cover any deductible but if it was the driver from the other car, you will have to go after them. You just need to go through your insurance company. They know the proper channels and have the lawyers to handle it.

Ok I have a question, if the OP's truck was just sitting in the parking lot at the dealer, and a car on the road lost control and smashed into it. Who is at fault?

I know this is NOT what happened, but the dealership says the accident was not the fault of the dealership technician. It was the fault of someone rear ending them and sending the OP's truck into an F-150 in front of him.

This whole thing sucks for the OP!

UPDATE: The post above kind of spells the situation out.

This story doesn’t add up. There’s no way the dealership can damage your vehicle while they’re we test driving it and not take responsibility. If this happened exactly the way you say, you should get a lawyer.
