So, I'm not really sure where to direct my frustrations. Maybe, people here can help me see a proper path to peace.

My 2022 Mav Hybrid XL had to be taken into the dealership (Brighton Ford in Brighton, Co.) where I originally purchased the vehicle as the powertrain failed at around 18k miles.

The vehicle was inspected and it was determined that the powertrain had faulty connectors and needed replaced. A common problem for the first year models.

Good news right?

So, while they were doing a final test drive the vehicle was rear ended, and hard. So hard the vehicle was pushed into a F-150 with a trailer hitch.

The dealership calls me and basically says "So, good news and bad news. We fixed the issue and your free to come pick up your truck and return the loaner, but your truck was involved in an accident and you need to have it taken to a body shop as we don't recommend driving it. But, it is drivable, and you can come pick it up and return the loaner."

So, I take my loaner back and they drive my truck around for me. Very serious damage front and back. I finally get a chance to take it in to a body shop for an estimate, and I've been told that the damage is so extensive they are amazed it's not wobbling as I drove it down the highway as the vehicle frame is twisted and bent. My radiator is demolished and I'm surprised I've not had issues with that, and you can feel the bend when standing inside the bed. Basically, my vehicle is totalled..

What really pisses me off is that if they total it our and refuse to repair the truck not only am I out of my beautiful blue truck, but I'm out a year of my life that I waited for my custom ordered truck, the $3k cash I put down, but also no vehicle on the market today comes with a 1.9% APR...if I have to buy a new vehicle I'm going to lose my shit and sit outside Brighton Ford and picket daily letting potential customers know that they will destroy your vehicle and leave you with the bill.

Anyway, I just needed to rant.

So, am I wrong for thinking that Ford should be making me whole? The dealership basically told me "It was not our fault so it's not our responsibility to return the vehicle in the condition it was received."

Lawyer. Even better, the local tv newstation consumer reporter, if there is one. Put it on television, except that won't happen if the dealership advertises with that station.

Messed up on many levels.
If this happend to me: 'Ooh, you wrecked my truck while in your possession? OK, I'll keep this loaner till you either fixed my vehicle, if that will be your insurance, the guilty persons insurance or out of your pocket I give zero fawks! Or you can give me a new truck. If you have any further questions call my lawyer!'

Also, see if your state attorney generals office will intervene. The CT attorney general has staff to help state residents from all kinds of abuse. I know because I called them and had a free staff attorney intervene on my behalf. All it takes sometimes is a call from a state lawyer, and that dealership will be bending over backwards to make things right.

I'd also unleash social media on them.

It's not Ford's problem, it's the DEALER. Quit blaming Ford.

No matter what you do it will be a headache. Since you retook possession of your car you might as well see it through the getting it repaired with your insurance. Try negotiating with the dealer GM or owner about reimbursement for your deductible and other out-of-pocket expenses. If they are not nice to you, and you have a lot of expenses, speak with an attorney. As a last effort, I also think that any investigative reporter would love to tell your story on TV while standing in the dealership parking lot.

I don't know how other states operate. I am in California the dealer is not responsible for damage to a vehicle while in their possession.

Story 1: We had a 2019 Chevrolet Bolt sitting at a local dealership for more than 180 days, waiting on parts and the replacement battery pack (per the recall). My insurance company informed me that I had to keep paying for the insurance coverage. I confirmed this with a lawyer as well as the dealership. FWIW, it was in the shop four times for 286 days (with only 14 days in our possession).

Story 2: I had a 50th Anniversary Corvette (with high mileage) at a different dealership, receiving a major service and several repairs. It was totaled by a woman who made an illegal left turn. Unlike the OP, the Corvette was not drivable. It was towed to an impound yard. I had to involve my insurance company to go after the woman since she lied to the police and her insurance company (before two witnesses with dashcam footage proved her to be a liar).

In both cases, my insurance coverage had to remain active and cover anything that happened to them in the dealer's possession.

The OP needs to get in touch with their insurance and have them go after the person who caused the accident.

Unfortunately, the OP will lose money unless their insurance coverage includes replacement value (where the company gives them the equivalent amount for them to go buy a similar model/configuration with similar mileage) which should be close to what they paid originally.

They are 100 percent responsible. Get a lawyer if possible but yes it’s all on them. It was in their possession that the accident happend. You shouldn’t have taken it off the lot at all. After all this you will have any pick of vehicle on that lot and for the same price u paid for the maverick. Good luck and I hope it works out for you. I’m actually pissed off for u. Once again the dealer screws the customer over. Unbelievable

So sorry to hear this. I worked at a Mercedes dealership and we averaged about 5 lot damage vehicles each month. Hindsight is 20/20 maybe keeping the loaner and having your insurance co give a call to their svc mgr may have been different. Good luck with the outcome, I’m sending you best mav vibes.😎

Also, do not forget to call the regional office. No dealer wants a client to call regional because it looks bad for them. Regional is their boss. I wish I had a phone number for you, but I do not. Maybe call another dealer and they will give it to you. I do not blame Ford and I do not think you should either, but they should be made aware of how this dealership treated you.
