Turn it over to your insurance company. Their lawyers will go after the dealer.
yep - that's the right answer - there's a lot going on here and that's what you paid your insurance for - for your ins co to deal with the dealer and the damage and for them to work it out. Just report it and let them handle it and be sure to get that police report that we'd all like to think the driver got from the faulty driver. Good luck.

Jumping on the bandwagon (had a brief stint in the insurance industry) to agree with these last couple comments. Everyone's saying lawyers, and they're right, but your insurance company has their own lawyers that you don't need to mess around with or pay in this situation. File the claim, tell them what happened, they'll bend over backwards to make sure that the responsible party (or that party's insurance company) gets the bill. Most likely, the dealer has coverage for when their employee's are operating a vehicle, your company goes after them. That company can decide if they want to pursue the at-fault driver's insurance, and so on. Might take some time, but I'd expect some action from the dealer once they get calls from your insurance and if not, your insurance company will sue on your behalf.

To say the least.

Let me get this straight -- and I'm paraphrasing.

A dealership takes a customers vehicle out on a test drive while it's in for service and is involved in an accident and then has the audacity to tell the customer that they have some "good news" and bad news?

Afterwards, the customer arrives to pick up his vehicle (what's left of it), and then the dealership sends him on his merry way in a vehicle that's unsafe like if it's just an every day occurrence?

Excuse my lack of compassion, but I'm still trying to make sense of this incident. I've heard stories of shady dealerships, but this is taking it to a whole nother stratosphere.

So, I'm not really sure where to direct my frustrations. Maybe, people here can help me see a proper path to peace.

My 2022 Mav Hybrid XL had to be taken into the dealership (Brighton Ford in Brighton, Co.) where I originally purchased the vehicle as the powertrain failed at around 18k miles.

The vehicle was inspected and it was determined that the powertrain had faulty connectors and needed replaced. A common problem for the first year models.

Good news right?

So, while they were doing a final test drive the vehicle was rear ended, and hard. So hard the vehicle was pushed into a F-150 with a trailer hitch.

The dealership calls me and basically says "So, good news and bad news. We fixed the issue and your free to come pick up your truck and return the loaner, but your truck was involved in an accident and you need to have it taken to a body shop as we don't recommend driving it. But, it is drivable, and you can come pick it up and return the loaner."

So, I take my loaner back and they drive my truck around for me. Very serious damage front and back. I finally get a chance to take it in to a body shop for an estimate, and I've been told that the damage is so extensive they are amazed it's not wobbling as I drove it down the highway as the vehicle frame is twisted and bent. My radiator is demolished and I'm surprised I've not had issues with that, and you can feel the bend when standing inside the bed. Basically, my vehicle is totalled..

What really pisses me off is that if they total it our and refuse to repair the truck not only am I out of my beautiful blue truck, but I'm out a year of my life that I waited for my custom ordered truck, the $3k cash I put down, but also no vehicle on the market today comes with a 1.9% APR...if I have to buy a new vehicle I'm going to lose my shit and sit outside Brighton Ford and picket daily letting potential customers know that they will destroy your vehicle and leave you with the bill.

Anyway, I just needed to rant.

So, am I wrong for thinking that Ford should be making me whole? The dealership basically told me "It was not our fault so it's not our responsibility to return the vehicle in the condition it was received."

Well, it's their fault or it's your fault. And, it's not your fault.
I think I would have refused to give up the loaner.

My two cents on this situation would be to either get the insurance company involved or some lawyers. I would have absolutely refused to return the loaner as well, but then again, I would have likely been in shock. Also, with how expensive parts and labor have become, the truck could certainly be totaled. I would also advise to contact Ford corporate as well since they might potentially try to help out as well. Corporate has had to deal with a ton of shady dealers as of late and in some cases they might be able to help out or at the very least, punish the dealership. Hopefully there will some update on this story for us to see what the ultimate outcome will be.

You pay for insurance so use it. Report the collision to them and let them do what they do best.

No way I would have accepted that truck after they wrecked it. I'd demand a loaner immediately and they would fix everything. That should NOT have to go through your insurance. This is 100% on the dealership.

Then I'd drive that loaner straight to a lawyers office and make sure it gets handled properly.

Being from a dealership once, they are 100% responsible to take care of any and all damages while the truck was in their possession. Furthermore, your insurance may not even cover this due an unlisted driver on your policy was driving. Surely they will try to bully you and scare you into handling this yourself but you are not responsible. Like someone else in this forum said, GET A LAWYER! they'll change their attitude real quick. Good luck

Yes they have insurance for these reasons, their insurance should be paying for the damage, it is 100% their fault unless somebody there lent it to their buddy who don't work there to try it and they crashed it without getting the guys info who rear ended them. all i can say is to seek legal advice and don't buy anything from that dealer again

unfortunately what "they" do best is take your money and then demand more money😂

having recently went through something like this....

if they aren't offering to pay for everything immediately call your insurance. in my case my car was backed into (in the parking lot) at a garage after the employee of the garage parked my car in a really dumb spot. the driver of the other vehicle (another customer) had no insurance. the business is paying for the body work but I had to go get the estimate myself which was a bit of a PITA but pretty much immediately the manager was on the phone and got the go ahead to pay for the repair.

Wow. I don't see this as a Ford problem. This is a Dealer problem that the dealer need to fix. The vehicle was in their hands being worked on. So the Dealers insurance and any others that was involved in the accident are responsible for responsible for the repair and to provide you with a loner vehicle. If need be, hire a lawyer in your area.

The dealer has insurance. Go after them. Let them go after who hit the truck. Get a lawyer, they can pay his fee also.
Ford WILL pay - you just need to lawyer up and take it to the mattresses. There was an incident here in Florida back in the late 90's-2000 where some girl got into an accident (not 100% sure of details) that was directly caused by some known issue with Ford vehicles - not sure if her vehicle caught fire or what happened, but she lost all of her hair as a result and had a long, physical recovery. I think Ford had to pay out a metric shit-ton of money to her and every time I saw her in St. Augustine, she was always driving a new Ford vehicle. I was told she would receive a new vehicle from Ford every year for the rest of her life in addition to the monetary payout.

Go after the dealership.
