Dealer claiming I need to resign purchase agreement (X-Plan) weeks after delivery

I think the issue is that I financed a portion. There is a clause in the purchase agreement that if the financing isn't approved by the third-party lender (in this case Ford Financing), then the transaction is cancelled and we are to return the vehicle.

This is what they are currently threatening me with. Since, we have been playing phone tag. I've left a message with the GM of the dealership with no reply.
Ugly. Leaving you no outs? Could you get outside financing and give them the remainder and be done? What did they do wrong?

And if they don't process the title then it's possession as proof of stolen property.
Not with a written salee contract it isn't.

Anything communicated over the phone is non-binding in the presence of a legal written contact.

If they need something more they can mail it certified.

I ordered in November 2021 notifying the dealer that I would be using X-Plan pricing. I was given the approximate totals and told the final price would be determined at time of delivery (incl fees, etc).

I took delivery for my truck earlier this month. The MSRP increased (as we all know), so they "price protected me" and included my X-plan discount. The total for the truck was only a few dollars off of what I was shown in November. I was happy.

Traded in my old truck and put 2/3rds of the final due down. Financed the last 10k at 0% over 36 months (also protected as it was offered at time of order).

Signed all the contracts and purchase agreements and drove away with my new truck. Woo!


The dealership called today saying they messed up and that Ford is not accepting the numbers they entered. They are claiming the order was submitted "retail" and not designated X-plan, so they want me to come in and sign a new contract with the increased MSRP and no X-plan discount. They say after 60 days, a check will be issued to me for the difference (to bring me back to the original amount they are selling me the truck for).

This sounds incredibly fishy. For those of you who were price protected, how did that process go? Was it in the form of a rebate check or were you just invoiced the original amount you were shown at time of order?
I bought using x-plan and also had to pay the higher price with promise of check. I bought 10 weeks ago and still haven’t received my check from Ford. I agree with other suggestion that you get FMC on the line to explain and confirm dealer story.

there have been some discussions on here about final window sticker price not matching original estimate due to price increases before your truck was built and delivered. Apparently the dealer is supposed to price adjust at time of signing sales contract when pick up your truck and then Ford repays them the difference. Pretty sure this is part of your price protection, and there may not be anything sinister behind requiring signing an updated contract so all the figures match in the end.

Of course I could be wrong on that.

Check directly w/ Ford Credit. There may have been a legitimate problem with the contract that needs to be addressed.

But unless you weren't eligible for the X-plan, their reasoning doesn't make any sense to me.

They may have reported the sale wrong to Ford, and didn't submit it as an X-plan sale....but I find that hard to believe.

I bought using x-plan and also had to pay the higher price with promise of check. I bought 10 weeks ago and still haven’t received my check from Ford. I agree with other suggestion that you get FMC on the line to explain and confirm dealer story.
With the plan prices....the notes from Ford for price protection does give the dealer the option to charge the updated plan price, and reimburse the customer the difference when Ford pays the dealer the price protection amount.
Probably takes 6ish weeks.

It is the dealer who will have to send you a check for that, not Ford.

I was approved for the loan without question, so I doubt there's issue with the eligibility of the loan in that regard. They're saying it's an issue with "some numbers not matching up".

They haven't called me back since around 2pm when I left my last message. It's 8pm now. Couple of things might be happening:
-I called their bluff and they're thinking of an excuse to have "figured it out on their end"
-They're busy as shit and don't have time for my whining
-They're getting a repo for my truck :p
I would reach out to Ford Financial and get the story from them. Have you account numbers with you and ask simple questions:
Who am I speaking with? Is my account in order? What percentage am I paying? and what is my payoff? After those questions are answered, reach out to your dealership and discuss them, fairly and honestly. Everyone makes mistakes, we are after all human, at least most of us. We should not be out to screw each other.... unless of course your dealer is a dick, in which case.. forget they exist. f your order is okay Ford Finance, there should be no issue. If not, then you have to get it fixed because your title is being held by them.

I wouldn't sign a new contract without the signed check for the difference or a letter of understanding stating they will give you the difference.

Also, why did you only finance a third of the cost when the money was at 0 percent? Even online savings accounts are paying 2 percent. On 20k that's 600 even considering the payments coming out of that money.

I called Ford Financing this morning. I was able to get some information, but since the funding dept was closed, not everything was clarified.

What I understand so far:
-The vehicle wasn't sold listed as x-plan.
-The amount of the loan on my paperwork and their paperwork match
-the price of the vehicle on my paperwork and their paperwork is different (reason unknown at this time)
-The loan on Ford credit's side looks good/accepted/valid. I have an account number and a first payment date and amount.
-They do not have any documentation/forms Titled "AXZD-Plans Pricing Agreement" which I do.

I speculate the people at my dealership are morons. Based off what others have said about price protection and x-plan, they should have sold me the vehicle at the new/higher amount and issued a rebate in the form of a check for the difference. Instead, they just sold me the truck at the Nov 2021 price and now things don't match up. Not once was the term rebate or check ever tossed around - leading me to believe they don't do a lot of AXZD-Plan deals or they're just incompetent.

I confirmed that the truck was not ordered/submitted as x-plan. They claim it was not because they didn't have exact x-plan pricing at that time.

Therefore, I must purchase the vehicle at the full price - to which Ford or the Dealer (unclear who) will reimburse me the difference after 60 days. Purely a formality to be compliant with mother Ford, I guess.

This story seems to align with a few other's who have posted in this thread.

I'll comply, but it's still upsetting they fucked up and now it's wasting everyone's time.

The dealership probably had the AXZD-Plans Pricing Agreement form printed, and had you sign that...but didn't have the contract listed as X-plan, so there was not "e-form" submitted to them.

The dealership can still sell @ x-plan price, even though the vehicle is not an x-plan. They will miss out one a (very) small x-plan commission that Ford pays the dealer though.

If this was your retail unit, the dealership should still get the "price protection" from Ford (basically the difference between the original invoice price and the invoiced invoice price).

I would suggest calling Ford Credit back when the funding dept is there. See if it is necessary on their end for you to resign/re-structure the contract.
If not....it is probably just the dealership trying to get that x-plan commission back. Or they are worried about being reimbursed for the price protection for some reason.

Truck Club, the first rule of Truck Club, Never trust the dealership. Contact Ford Credit and see what they have to say. I never trust the dealer...
