Get the best deal you can out of the insurance and dealer. Then put in another order and flip it when you get a early 2023. Barring a total market collapse you could easily get what you paid for it or more in this market. Slight gamble but not by much.

I'm sorry that happened to you. I'm glad no one was hurt. Obviously this is all a bit more complicated than I am about to make it sound because this is a truck you have wanted for the better part of a year I'm guessing?

First off Liability for the accident... 100% the kid - not you. I was once boxed in and couldn't stop in time when a 86 year old got confused and just stopped on the the freeway and I rear ended him. Fortunately, I got it down to about 12 mph before impact, but I hit the car. It was deemed 100% my fault. If you run into the back of another car it's your fault, unless someone just ran into you and pushed you into them.

Second - The driver of the Jeep has primary insurance responsibility for the accident. The owner of the vehicle (the dealership or their bank) has secondary, and you only have tertiary. Sure the other insurance companies would love for you to try to get your insurance to pay, but even if they do get involved they will go after the kids insurance for reimbursement.

Finally, you are under no obligation to buy the truck. Sure the dealer wants you to feel like you do - they want full sticker and only you are likely to pay it - because you are a nice guy. You need to remove yourself from the equation - if you walked in off the street with no reservation and no order wanting a truck and they were offering to sell you that truck, with its repair history, what would you pay for it? You can wait 9 months for another one, go to another dealer that maybe has something and pay an ADM, go buy a used Toyota, or keep driving what you are driving. These are all valid choices. Feeling like you should buy the truck because you were behind the wheel when the kid hit it though is sentimental and silly. If you can get a deal that works for you, take it.

If you do consider buying it though, ask yourself this (or ask your insurance company) If it gets totaled in another accident in a week, are they going to base the residual value of the truck on the price you just paid for it, or the value of a truck that has had its unibody repaired? If you Stroke out next week and the kids have to sell it to pay off the farm, are they going to be able to get a fair price versus what you paid for it when that accident shows up on the carfax?

Nobody is going to give you a bonus, or even a lollipop, for being a good guy if the situation changes next month, so make sure you get a fair deal if you do go through with the purchase. Don't get me wrong, it's a great truck, and it will make someone very happy after it has been repaired, but it has to be a good deal for you.

After waiting 11 months and 1 day, my Maverick Hybrid XLT was ready for me. It was beautiful, had 3.4 miles on it. The salesman suggested I take it for a drive while he finished getting the paperwork together. My wife and I went down the nearby freeway to the next exit and turned around to come back to the dealership. I stopped at a yield sign on the service road (less than 1/2 mile from dealership) and was rear ended by a kid in a jeep. Bumper, tailgate and bed wrinkled. Fortunately the kid has insurance. So the Maverick I ordered is in the body shop with 8 miles on it.

But here is where I need advice from this forum... I haven't signed anything yet to take possession. So I thought the dealer would pursue the insurance claim, but they think I should do this since it is my order. Can I even collect insurance for repairs on a car that was not titled to me? Should I be paying full MSRP on a car that has been in an accident and the trade-in value is diminished? Or should I wait until after it is repaired and test drive it again before taking it?

Every one is different. This is your truck. Technically not but the sales person would not have let you drive it otherwise.

I would contact my insurance. If they said yes it falls under my insurance then I would own up. I'm guessing your insurance will say nope.

However it shook out I would take delivery of truck once fixed.

My guess is this dealer will put in place a policy not to let people drive there ordered vehicles until officially transfered. Sounds like best practice to me.

How is this different than a dealer adding paint protection, interior protection and window etching jacking the price up 3 time the value of these services.
When you mention hey I didn't order this, answer it's not your vehicle yet. Belongs to us. Can a dealer really have it both ways.
You either pay extra walk away, dealer then adds another 5k for some chump to overpay.

I would think this truck was not meant to be mine if this happened to me. I would let them get another one or see if they will reduce the price after they fix it and then make a decision. I would be surprised if your insurance company would pay for damage when the truck title is not even in your name and it wasn’t your fault. I will be interested to hear the outcome.

That is ...so terrible. Here's what I'd do: Have the dealer file the claim vs. the kid's insurance company, then when the estimate is completed have the dealer ask the insurance company to just send them the check for the damages (sometimes they do this), then the dealer does the body work ...at cost... and they pocket the additional $ that are the profit margins that are included in repair estimates.

Depends I would walk away and order a 2023 Hybrid AWD when and if that comes out ;-) No matter how bad you want this Maverick you may regret it later and try to swap down the road. Then you will learn your trade will have 20% less value due to the accident. Sometimes in life you get lemons... Know when to cut your losses. OR if you own a business and will put this truck to work and never have a second thought then fix it and take it.

I'm not a lawyer. The truck belongs to the dealership. Why should you pay for repairs?

Would they expect you to pay for repairs if it was damaged coming off the truck?

What about if it was damaged by hail the morning before you went to pick it up?

Just a question here. If you borrowed a friend's vehicle who pays for the accident you are borrowing you or your friend? On this one he was not at fault so it should be the other driver.

Just a question here. If you borrowed a friend's vehicle who pays for the accident you are borrowing you or your friend? On this one he was not at fault so it should be the other driver.
Call your ins and they should be able to tell you
