Sad Maverick Owner. So mad at Ford...

So, I'm not really sure where to direct my frustrations. Maybe, people here can help me see a proper path to peace.

My 2022 Mav Hybrid XL had to be taken into the dealership (Brighton Ford in Brighton, Co.) where I originally purchased the vehicle as the powertrain failed at around 18k miles.

The vehicle was inspected and it was determined that the powertrain had faulty connectors and needed replaced. A common problem for the first year models.

Good news right?

So, while they were doing a final test drive the vehicle was rear ended, and hard. So hard the vehicle was pushed into a F-150 with a trailer hitch.

The dealership calls me and basically says "So, good news and bad news. We fixed the issue and your free to come pick up your truck and return the loaner, but your truck was involved in an accident and you need to have it taken to a body shop as we don't recommend driving it. But, it is drivable, and you can come pick it up and return the loaner."

So, I take my loaner back and they drive my truck around for me. Very serious damage front and back. I finally get a chance to take it in to a body shop for an estimate, and I've been told that the damage is so extensive they are amazed it's not wobbling as I drove it down the highway as the vehicle frame is twisted and bent. My radiator is demolished and I'm surprised I've not had issues with that, and you can feel the bend when standing inside the bed. Basically, my vehicle is totalled..

What really pisses me off is that if they total it our and refuse to repair the truck not only am I out of my beautiful blue truck, but I'm out a year of my life that I waited for my custom ordered truck, the $3k cash I put down, but also no vehicle on the market today comes with a 1.9% APR...if I have to buy a new vehicle I'm going to lose my shit and sit outside Brighton Ford and picket daily letting potential customers know that they will destroy your vehicle and leave you with the bill.

Anyway, I just needed to rant.

So, am I wrong for thinking that Ford should be making me whole? The dealership basically told me "It was not our fault so it's not our responsibility to return the vehicle in the condition it was received."

So, you took your Maverick in to a Ford dealership to have repairs done, they test drove it and got into an accident while a Ford dealership employee was driving it? I kind of think they are 100% responsible for all the repairs since they got into an accident with your Maverick and provide a loaner while it's under repair.

This is like them saying we had your Maverick on the lift and it fell off, now take it somewhere to get an estimate for repairs and get it fixed!
You are absolutely correct.

The dealership has 100% responsibility in this matter. You brought the truck in for repair. They drove it when it was in the accident. They should be returning the vehicle to you in the same condition as when it was brought in. If it is considered totaled, then their insurance company should be giving you full market value of the truck. Unfortunately, that does mean you have to go out and buy a new/used vehicle. Maybe there is another 2022 Maverick for sale somewhere that you can track down, or maybe this dealership will step up and try to find on for you. And it is a bummer that the great financing you got before isn't available now, but that could happen to any of us who are involved in an accident. If by some miracle the dealership steps up and finds you another vehicle, maybe they would further step up and offer you identical financing.

Oh, HELL NO!!!! That dealership destroyed it and they should get you a complete functional car that matches yours. This is most frustating. Good luck.

It's time to get a good lawyer and not only make them pay for the repair but also sue them for legal fees & heartship! A couple of years ago a Chevy Dealer incorrectly placed my 2014 Stingray on a lift and ended up cracking the quarter panel. Composite material can not be patched. I happened to know that. I immediately told them, once I sensed some resistence from the dealer to make whole, that my lawyer was going to contact them. I made sure I mentioned the name of the nastiest lawyer in town. They did not even wait for the attorney to contact me and I ended up with a new quarter panel.

Here's another reason why the OP needs to contact an attorney. Not sure it's the same in other states, but my insurance company wants to know every possible driver in my household that would have access to my vehicles. For years my policy only had me on it. Then they changed their policies that require all names on the policy somehow (either as combined on the policy, like a spouse) or as a driver on said policy.

My wife's name is now on my policy even though she has ZERO reasons to drive my cars (Mav or my Mustang GT). But they required it. If OP goes to his insurance company, and he explains he wasn't driving, they will want to know who was. He says the dealer technician. They may say, he's not a covered driver on your policy and they may not pay (if it were his fault of course). This is why the dealership needs to take care of this in house ASAP.

It's time to let the dealership general manager know that you will be contacting your attorney - make sure you mention the nastiest lawyer in town - and they will not only be sued for the cost to repair, but also for legal fees and heartship! I had a similar incidence when a GM Dealer did not correctly place the lift pads under my 2014 Stingray and cracked the front left quarter panel. The dealer did not wait to hear from the attorney, but instead very promptly acknowledged that they would pay for all damages and that I could take the car to the body shop of my choosing. I ended up with a new quarter panel and a first class paint job. Total cost was right around $ 5,000.00. All Dealerships carry Liability and Accident Insurance. Let their Insurance Company pay for everything.

So many on here with legal advice. Colorado is considered a "fault state." This means the driver who caused a traffic accident is financially responsible for any expenses related to property damage or injuries sustained during the crash. This includes loss of income, death, vehicle damage, and damage to city property. Unless dealer employee was negligent in any way not a dealership responsibility. Most States insurance follows the car, not the driver. Loan your car to someone and they have an accident it's your insurance that covers the accident. It would be nice of the dealer would be helpful in other ways.

Ok I have a question, if the OP's truck was just sitting in the parking lot at the dealer, and a car on the road lost control and smashed into it. Who is at fault?

I know this is NOT what happened, but the dealership says the accident was not the fault of the dealership technician. It was the fault of someone rear ending them and sending the OP's truck into an F-150 in front of him.

This whole thing sucks for the OP!

UPDATE: The post above kind of spells the situation out.
You as owner can purchase insurance "for the vehicle". If you want coverage payable to you then you can add riders to the policy like replacement coverage, gap, etc. The vehicles policy covers the vehicle for damages. It seems hard to understand for some but your the vehicle policy without riders may not be covered in some instances. War? Insurrection? ???

Look up the definition of bailment. I am not an attorney or if the rule still exists as 50 years have passed since taking business law classes. The short version is that when the dealership took possession of the truck they own it.
Hopefully someone from Ford that monitors this site can help you and will rain fire and brimstone onto the dealership.
For future reference to anyone else don’t take possession of the vehicle. Leave on the lot and let the insurance companies battle it out.

Thanks to the original victim of this crazy story. I will ask my dealer what the deal is with them as they pick up my truck and drive it 18 miles each way to get the latest recall done (or check for why mine goes to deep sleep all the time, an ongoing problem). If it gets damaged in transit, I need to know what will happen. An eye opener, and I hope you get a fair deal. I would not want that truck repaired, it is a mess, and what about mechanical and underneath problems not obvious from above? I love my truck BTW, but would prefer less recalls.
