After finding out my October 9, '21 order was never rolled over by my dealer and thereby preventing me from the 'price protection offer' i have threatened legal action. What else can I do?

Mine has been sitting for about 30 hours at the NS Conway, PA yard. It's about 300 miles outside of the Wilmington, DE where it will need to be loaded on Convoy.

Mine has been in Chicago area for over a week now

That means your COVP was never completed for the '22. If they completed the COVP there is no "roll over", they place another order and you should have an offer in Smart Vincent.

My ‘22 XLT Lux Hybrid is now scheduled for the build week of Nov 14. I get pushed back every week. A few weeks ago I had a build DAY of Oct 18. I’m starting to lose all hope of actually getting it.
My original build week was 8/22, then 8/29, then 9/5, then 9/19, then build 'day' of 9/24, and it was built on 9/26. It is now in transit, CS said it was in St. Louis yesterday, but not on a rail. It's hard to be patient, but we'll get our Mav's soon!

That means your COVP was never completed for the '22. If they completed the COVP there is no "roll over", they place another order and you should have an offer in Smart Vincent.
Wait- can you elaborate? I believe my COVP was completed if I understand correctly.

If COVP was completed you should have either a VIN or a special offer. Have you ever gotten emails directly from Ford about your order ?

Call or chat and ask if you have a special offer certificate, they can provide the #. It gets tied to the name that was on the COVP. You will need your order # from the dealer to provide to them.

If you don't have one, that can be fixed by a " Sales & Inventory Specialist" that your dealer can get to look at your order to add the offer. To be able to use the offer, you must have a '23 order in. If your dealer didn't put in a '23 order for you, then certificate or not you will be unable to utilize the certificate, it is designed to be applied to a retail order in your name. If you ordered a '23 at ANY dealer, and have a COVP for a MY '22 that never got a VIN, you will qualify for the certificate even if you change dealers, but the big issue is since order banks closed, if you don't have that order in you are up a creek.

I don't think Ford make a big enough effort to communicate this with dealers, but they DID send a memo out, and some dealers (including mine) have sales managers that this never gets relayed to from whoever gets the emails.

I don't think you have any angle for any legal action ( but I am not a lawyer ) and you typically get more flys with honey than sugar. Figure out where the disconnect was, then ask the dealer what they will do to make it right. Maybe they put you first on a list of cancelled orders, and no ADM, but pretty much I think your best option is seeing what the dealer will willingly do for you. I can't see the juice being worth the squeeze on trying to do anything legally.

(please take all above advice as just someone who has dove deep into a lot of this, I am not a dealer/Ford employee so I may be incorrect on certain things)

Thanks - very informative- my dealer never rolled order over and now I’m in the creek you mentioned- I asked dealer to remedy their error- waiting to see-legally it’s just a simple petition court for specific performance which means they provide a truck (doesn’t matter how) and i pay &26,660 plus TT&T as agreed according to my documented with plus deposit

Posting details on the last leg, unless you all feel it clutters the thread.

You all know did the Ford Chat at 12:10PM Monday and my truck arrived at the rail destination. Then @Crash looked up my rail car # via CSX and got the info, which was unloaded at 4PM. Had some calls with the dealer, BDC Manager. My sales guy did not have access to the the ROVP on Oct 25th when ordered and when followed up the next two days was bounced to the BDC Manager and since have had most of the communication with him. Both the salesman and BDC guys are out on Thursdays. They called down and my truck is schedule to be delivered this week. Told to call around 10AM tomorrow, Wednesday and talk to the sales manager and the BDC guy will be there as well. They should know if the truck was load earlier in the AM for deliver. The plan is most likely to pickup Friday. However the BDC Mgr needs to explain to the Sales MGR to charge me $100 for the doc fee. As that was the agreed comprise since ordered the truck without the x-plan and found out later. Unless there are objections will post after the calls tomorrow.

Best of luck to you. A lot of us are learning hard dealer lessons with this truck. I stand by the opinion someone should have to spend hours online to be able to get what they want at a price agreed with no shenanigans from the dealer.

You know who to avoid down the line, and oh boy I can't wait till inventory catches up and the roles are reversed back to the customer walking being an actual concern for a loss of sale rather than excitement over slapping an ADM and selling it to someone else within a week.

At this point, unless I can see a $5k profit over trading my '22 in next year, I doubt I will be buying for awhile unless the 24/25 has a really compelling PHEV. Last car lasted me 16 years, it is wild I will have owned 2 separate brand new vehicles this year.

Mine has been there for 3 weeks. I am only 2 hours away. Mine has a delivery ETA of 9/30-10/6. So maybe Thursday, but wont be shocked if it is later than that.
You get your truck out of the rail yard yet?
I guess im one week in and stuck in the dreaded "ramp 6p" that East STL thread keeps talking about.
--The most recent update as of Oct-04-2022, 15:40 CT reflects a current location of Ramp 6P, Kansas City Mc, MO--

Guess im just checking tracker multiple times a day and ford chat once a week

Had just two updates and they were 8 days apart. Good luck @bajesus8 . That said have been twice lucky thru this ordeal plus my follow-up with several calls until knew the RVP was entered. Once getting selected for a MY22 build and then most likely to receive my truck 3 weeks or 3 weeks and a day after the build. Believe @fordvideoguy uses a rule of thumb of 4 week.

PS. The East Brookfield, MA ramp is in rural central Massachusetts and does not seem to have the bs delays on the off loading ramp in other locals.

Wow that's really soon! Confused on the compromise. You don't need to order with the X-plan to get x-plan pricing, just need a valid pin and dealer that is accepting them. Or the compromise was to do regular (protected) pricing but the $100 doc fee (like the Xplan)?
