No police on scene? Driving erratic, then crashing, at 2:50 am is 99% probability of DUI.
There were police on the scene. The property manager called them when she found out he didn't have insurance. He wasn't drunk. Just young and stupid.

Most of us have been there for one thing or another. If we're lucky we survive and learn from it. A couple of my friends were not so lucky 50-some years ago. That he wasn't high on something at 2:50 am is to his credit. This is going to cost him BIG so hopefully he will now grasp the importance of taking the time to be safe, and of having insurance. Glad nobody was hurt and that your truck came out relatively unscathed.

What was the tri-ball hitch picture supposed to be here for?
Without a trailer attached, nobody should have an unused hitch inserted either in a unibody or full-frame truck. Having the ball-mount and the ball installed to catch more of the guy's bumper would have massively increased the damage to the rails of the truck and probably caused it to be written off.

It's an uninsured driver.... you're suggesting extracting blood from a stone.
So? If Insurance handles it it costs nothing and has only benefits. If they don't, then nothing has to be done.

He was driving without insurance becuase he made a poor life decision.
Suggesting to the OP that he sue to extract money from this impoverished person who makes poor life decisions is probably an exercise in futility.
20 years ago, an uninsured motorist entered into my lane on the freeway, damaging every panel on the passenger side of my car.

I got the car fixed using my uninsured motorist coverage.

2 years later, I got a check from Allstate for $500. I called my agent and asked him what it was for. He said it was a refund on the $500 deductible that I paid to get the damage fixed.

So I asked, why am I getting the deductible refunded? He said, because our attorneys sued the uninsured motorist, got a court judgement against them, and then garnished their wages. And I got the refund after the entire debt had been paid.

Because I used my uninsured motorist insurance, and my insurance company had to pay out $8,000, my insurance company was motivated to sue, while I had zero motivation to sue.

But it does prove that you can get blood out of a stone…… as long as that stone has a job.

Make sure you inspect your sub frame rails underneath the vehicle for any damage.
I had a thorough inspection done at the body shop on a lift after expressing concern seeing all the totaled trucks here from minor fender benders. They said everything was good.

1. Insurance company suing them for damages (and the deductible) has a better chance at success than victim suing. So, in time the stone might bleed.... but let it be the insurance company that goes through the gymnastics.... best to just get the car fixed, pay the deductible, and move on.. possible future consequence for the poor life choice on the side of the perpetrator.

2. The victim has lost thier ride too. consequence for their poor life choice.

3. The victim will get points on their license, making insurance even more expensive in the future. Or in some cases, loose their license altogether. another consequence for their porr life choice.

Again, I'm suggesting let the insurance company do your bidding. If you're out a $500 deductible after they've tried to collect something, then you probably would have not succeeded either. Accidents are frustrating enough. Trying to get justice all on your own is frustrating and exhausting. Let the insurance handle it.

Your insurance may pursue the driver for the deductible on your behalf, and if it's anything like mine, a not-at-fault uninsured motorist claim doesn't affect rates. It might be worth messaging your insurance agent and asking a few questions.
I called my agent and picked his brain a bit on the matter. He said the deductible is only $500 for an uninsured motorist claim. But if there was a police report then it drops to $200 or $300 in the state of Oregon. It also won't go against you as a ding on your insurance claim history, thus not raising your rate. I have a police report so I decided to file a claim. It is worth getting fixed for a couple hundred dollars. Thanks for the tip!

Looks like the perp got the most damage . . . as if should be. Glad to hear your Maverick was basically untouched. Talk about a close call.

Glad everything is okay! I sure am tired of hearing about people driving carelessly and then of course being uninsured! It happens a lot where I live and there are no consequences or at least that's how it seems. But the rest of us have to have higher rates and pay for uninsured motorist on our policies. Rant over
There are definitely consequences. The type of people who do this simply do not care about them
