Well that sucks ..... you are far better off with that settlement than that much damaged repaired. Glad they didnt jack you around - I got hosed a few times with "uninsured motorist"

Hope your insurance company sues them into poverty. I HATE HATE HATE lazy uninsured motorists.
The uninsured gets a piddly ticket which is no where near what insurance premiums cost. So they pay it (sometimes), just drive their vehicle with the damage or go get another junker, and do the same damn thing. While LAW abiding citizens pay the premiums, claim against the insurance, rates get hiked, and are financially responsible for whatever insurance does NOT cover such as rental cars until repairs or replacement is completed. I saw pass a law stating uninsured motorists involved in an accident have liens placed against their property or pay checks until proper compensation has been completed.

I think that sending it to internal claims is standard procedure for totaling. I'll ask my son (contract ins adjuster) when I talk to him. Too bad he did not have replacement coverage.
Buried in your post is great advice about having replacement coverage with your auto insurance. You also want to have gap coverage although nowadays used car value has turned upside down in that they are worth more now than new. Go figure.

I thought that "uninsured" coverage has a fixed deductible of $250 not the $400 shown in your repair report.

Is uninsured deductible different in other states because here in Texas it is fixed at $250.
In Washington State, uninsured and under-insured policies and riders are optional insurance products and do not have stated deductible limitations. It's whatever deductible you select and pay for from your insurance carrier. However, a financer may have stated coverages and deductible limit requirements to protect their interest in the property.

Looking at the initial estimate I was sure the Ins would total it. Some of the parts prices were quoted real low since no aftermarket parts are available yet.


Gonna order a new on when orders open up later this year?

I am going to have to ponder if gap insurance is necessary with replacement cost. Might not be necessary if existing financing allows substitution of vin # of replacement vehicle or if insurance writes check for the agreed upon replacement cost amount existing lien could just be paid off. Of course there is a possibility replacement cost could be less than lein amount. GAP rider with replacement cost rider also should be quite cheap I would expect.🤔

Right off the rip it is missing the transmission which is stuck in drive(All State said their internal claims will decide that one especially since that sends the estimate to 26k for a replacement that costs 7k), the bed storage box that I have pictures of showing it broken and thats assuming no body work there, the dent in the middle of the bed that the body shop thinks will be a cut out and weld a plate into and blend it in(That will also mean bed liner be redone by Line X), and the upper radiator mounts that I have pictures showing bent and a very likely ruptured radiator plus any surprises that are likely to arise.

In Texas uninsured deductable is whatever your collision deductable is. Texas the amount of collision deductable is what ever the insured chooses to pay for. If you do not ask the agent will choose an amount.

This is not true. The uninsured deductible is fixed at $250 and cannot be changed. My insurance provider ALLState states that it is fixed at $250.

Also not true as I have a $500 collision deductible and the uninsured deductible is shown as $250.

That is nuts. What was their basis? Actual market value of a new dealer stock?
Yes. Alabama law is actually cash value. They based it off what I could actually buy today.

It's official!!!!!! I am being sued for injuries!!!!!! On a wreck deemed not my fault by police and insurance!!!!!!! Great country we live in!!!!!!!!

It was their fault.....but I am using my uninsured as they had none
Shit like this drives me crazy. I think if you get caught driving without car insurance, you revoke all rights to drive for at least a year. Too much of this BS going on in this country. Driving is a privilege, not a right, and if you can't be responsible for your actions then everyone around you shouldn't have to pay the price.
