This post is dripping in ignorance on the topic. When there is a delivery hold on a vehicle due to a safety recall it is mandated by the Feds. You can call as many Sauls as you want. They cannot fix that.

Class action would be tossed. There is no class in which the action is necessary as this is a singular injury performed by a singular dealership (you don't buy from Ford) at the behest of a federal agency. And if the feds are blocking the title transfer, then there is literally nothing the dealer or Ford can do about it other than give you a refund.

It sucks, but until the airbags are fixed there is little you can do but vent.

If you paid for it they should refund your money until you get your truck or you decide to walk away. The dealer can't let you take it once the safety notice is out there so they don't have any options. If it sits outside for months I can see that you might not want it but a lot of cars bought off the lot have sat outside for months.

If this goes to a class action you will get an oil change and the attorneys will get tens of thousands of dollars. It won't be a huge number of consumers.
Got all my money back promptly. All of it. But I kept the signed paperwork and worked out a deal that they store my Lariat in their showroom, out of our wintry weather. Dealer is not any problem, but federal NHTSA is over reaching here. I just need to vent some-

No, the dealer literally messed up by trying to sell you a car with a delivery hold on it. That's the very definition of problematic behavior. They're not even allowed to demonstrate the car to you - meaning they're not supposed to show it to you at all, certainly no test drives.

NHTSA isn't overreaching, they are doing what they are required by Congress to do. Complain to them that you want dealers to be able to sell brand new vehicles with safety recalls on them (albeit a relatively minor safety risk in this case). The vehicle does not comply with current FMVSS safety standards, therefore, it is not legally allowed to be sold as new in this country.

OP implied that he paid for the truck, dealer had the money and he had no truck.

In that case, the dealer would be fucked legally. And an attorney would have enough leverage to get him damages or maybe another truck.

Would that "fix it"?
This is simply not true. A delivery hold is something mandated by a Federal agency. It cannot be undone, even if there is an exchange of money. It would be HIGHLY unusual for a dealer to take that approach anyway. I had a delivery hold on mine for the brake light recall. We signed the papers so the truck was "mine" The deal was not funded (financed) until I took actual delivery.
