How is this different than a dealer adding paint protection, interior protection and window etching jacking the price up 3 time the value of these services.
When you mention hey I didn't order this, answer it's not your vehicle yet. Belongs to us. Can a dealer really have it both ways.
You either pay extra walk away, dealer then adds another 5k for some chump to overpay.

Not sure how it would work but something along the line of see if the dealer would sell it at a discount, drive it until you can order another in August
Trade it in on the 23 when it arrives (with some kind of trade in value agreement?)

That way you could at least enjoy the Maverick

The dealership owns the truck until you sign the paperwork. No way would I let my insurance be involved.

I would hold off signing paperwork until the truck is fixed to your satisfaction.

Since it now damaged and the value has dropped I would negotiate a lower price now that it has been in an accident.

Someone will pay MSRP+ for it, I don't think the dealer will take a loss on this vehicle.

Recoup the difference from insurance as finished value so they aren’t taking a hit on it
A wrecked and repaired vehicle is not worth the same as a non-wrecked and repaired vehicle all other things being equal

The dealer still has to pay Ford full value for it. It looks like fairly minor damaged that can be repaired. Obviously, if the damage is structural, that is a different issue.

Every state has a different law about what is "disclosable" damage on a new vehicle. It can be $ amount or % of MSRP. Huge differences between states' laws here.

If the damage is minor enough that it doesn't have to be disclosed, it is unlikely that the dealer will discount the vehicle.

After waiting 11 months and 1 day, my Maverick Hybrid XLT was ready for me. It was beautiful, had 3.4 miles on it. The salesman suggested I take it for a drive while he finished getting the paperwork together. My wife and I went down the nearby freeway to the next exit and turned around to come back to the dealership. I stopped at a yield sign on the service road (less than 1/2 mile from dealership) and was rear ended by a kid in a jeep. Bumper, tailgate and bed wrinkled. Fortunately the kid has insurance. So the Maverick I ordered is in the body shop with 8 miles on it.

But here is where I need advice from this forum... I haven't signed anything yet to take possession. So I thought the dealer would pursue the insurance claim, but they think I should do this since it is my order. Can I even collect insurance for repairs on a car that was not titled to me? Should I be paying full MSRP on a car that has been in an accident and the trade-in value is diminished? Or should I wait until after it is repaired and test drive it again before taking it?

If you have not signed anything then Ford has a problem not you. Don’t buy a wrecked car at full price.

It might be that even after the truck is fixed they could still sell it to someone else for more they you are paying. But I would not pay full price for a wrecked car.

I have heard, but don't take it as the gospel, that dealer repairs to untitled vehicles do not get reported. If so, and repairs are unnoticeable, no harm done. Otherwise go for diminished value from the smartphone-distracted kid's insurance.

All good points. Lots of people on here reported ordering their Mavericks sight unseen, and most completed the transaction. Many people have scoured their regions looking for walk away cars and make offers over the phone and rush down to buy the vehicle with little info about it. Assuming there is no report-able damage repaired, I would bet members of both groups I mentioned would buy it at least at MSRP, with no reservations about it- and happily report back here "I finally got one!"

Yeah, I mean I certainly understand why someone would want a discount in this case, but I don't think it will happen. It is not the dealership's fault in this case, and I don't think that they will be in a hurray to discount a vehicle that someone else will be happy to pay MSRP for.

Also, I think that more body damage issues are fixed by the factory or in-transit than most of us know about..... these aren't put through insurance or warranty, so there's no way for the consumer or dealer to find out about!

Ask a lawyer for a free consult over the phone and ask them this question. I would give the kids insurance information that rear ended you to the dealership. Did the dealership ask for proof of YOUR insurance before they let you drive the vehicle?

Dealers DO carry insurance for this very reason and they are capable of paying for it themself. I would think that even if the accident wasn't your fault, even if you gave the delaership your insurance, they would still go after the kid who rear ended you's insurance. And even if they tried to go after your insurance, your insurance wont pay because it wasn't your fault and you have the other kid's insurance information available.
