Ok, wow, I prob should have clarified. This stretch of road has a posted 55mph limit, I was not going much faster than that. This Intersection was recently blocked off to prevent this exact occurrence, but instead, most people go around the barrier, like this person did. IDK why I'm surprised by people blaming me for this, but it is what it is.

The officer on the scene, after watching the video, confirmed I was 0% at fault in his opinion.
I haven't read further than this post yet. Also glad no serious injuries. And totally sucks about your truck. But I will saw, unfortunately, I'm sure your insurance will say you are at fault. Close to a 100% of the time when a person rear ends another vehicle the insurance companies say it is an avoidable accident. I hope this isn't the case in your circumstance.

I see these kinds of videos on youtube all the time. What exactly is the thinking of somebody who does this???

How does a sane, rational, moral person just pull into the middle of the road and believe they can make a u-turn like that???

What kind of brain damage must one suffer to believe it is a good idea to merge into traffic like that??? Then, not matching the speed of surrounding traffic is the next best decision they can make??? TTHHEENNNNN... Using what every lane they want just bang a U-Turn like it's their right??

Did she offer some explanation for her actions?? I am always curious as to the thought process of these total drains on society!

Take one look at the current drivers education system, and the effort needed to get a drivers license, and it's a miracle the carnage isn't way worse.
The real problem is cultural though, we believe that driving is an American right, only to be revoked, on a temporary basis, on the absolute most extreme exceptions and even then when people are caught driving with revoked driver's license the punishments are typically no more than a slap on the wrist. Was just watching A&E for example, and the cops were so proud of themselves as they pulled over a guy that had fake paper plates, no registration, revoked driver's license, and weed in the car, but because he was super honest they let him go with a warning. Then you have a pilot's license by contrast where revocation is pretty much guaranteed for lapses in safety, totally different culture and not considered a "right".

IMO we should implement the same driver education and testing as they have in Germany, and when people are caught with revoked license for repeated drunk driving and what not, unless the vehicle was declared stolen (in which case driver is arrested for theft), the vehicle gets impounded and auctioned off with the funding going to fixing the roads and more traffic enforcement. If that means that there are 15% less drivers on the road, great! Also need more enforcement of hit&run. Here in TX the drivers almost always flee the scene, because as long as there isn't serious injury its just a misdemeanor charge punishable with a fine but rarely are they caught and even more rarely do judges try to enforce the penalty as they'll either get out of it by rescheduling repeatedly until the cop doesn't show up which is immediate dismissal or say they don't have the money and need the car for work in which case they usually just get probation.

Let's be honest about this. The OP and the Jeep were both committing moving violations at the time of the collision. Illegal conduct from both parties obviously contributed to this accident, regardless of the percentage of fault that is ultimately determined.

PSA: Driver impairment/distraction and speeding are leading causes of accidents.

This isnt' a defense of the Jeep driver (whose driving is objectively awful) but from the Jeep driver's perspective, they may have thought they had time to merge into the left lane without cutting off the Maverick in the right but misjudged due to the OP going above the posted speed (by how much, he doesn't say...)

yep, there was nothing an avoidance system could have done - the limitations of that system are dependent about physics - there was no way this was going to be avoided.
100% incorrect. Entirely untrue. There was plenty of time to stop had the driver chosen to slow down instead of choosing to attempting a high speed evasive maneuver... never mind the avoidance system.

Hindsight is 20/20 but more broadly speaking... when a car cuts in front of me I slow down. 🤷‍♂️

I don't think the OP had time to stop safely because of the mixed signals the Jeep driver gave off.
Mixed signals? Great time to slow it down!
------------------------

This accident demonstrates why I purchased the top trim Lariat with all the safety features.

My Mav has the radar box with a pre collision alert signal in addition to the AE braking. I have the radar set to maximum sensitivity. The dash would have gone off with a warning as soon as the radar/camera detected that speed differential with the vehicle pulling out in front of me (which is to say, immediately as they made the turn).

I know this because it happened to me just the other day. No drama to report because I was driving defensively and gently tapped the brakes instead of trying to speed around the offender like a bat out of hell.

Two general rules of thumb.

You KNOW the other guy's an idiot so drive accordingly.

Ultimately, YOU are the one responsible for how you drive your vehicle.

Everyone's fine, but the Wrangler driver wasn't in a big hurry to explain why she stopped in the left lane.

"He pushed me into the other lane!"
Wrangler driver needs to go left (from cross traffic to go in opposing direction of OP) but intersection only lets her turn right. Obviously too lazy to drive the extra quarter mile to turn around properly, she just sits in the left lane and waits for opposing traffic to clear so she can make an illegal u-turn. I live right next to a very similar intersection where people do this kind of thing all the time. People will make others suffer through all sorts of bullshit just to shave 15 seconds from a commute.

Gotta be honest, not my proudest moment. I should have been on the brakes from the moment she was straddling the line. I was never expecting her to cut left and stop.
I'm not reading through 8 pages of posts, but you're not at fault for insurance purposes.

From a common-sense perspective, this person pulled onto a 55 mph road, didn't try to get up to speed, but instead cut over into your lane while hitting the breaks (after you changed lanes to avoid her). At the time of impact, the jeep was in BOTH lanes. The wreck could have been easily avoided had this jeep not been on the road or had the driver of the Jeep been a decent driver.

For ambulance chasers, they could try to claim you were at some % fault here because you didn't slam on the breaks. That said, no one in their right mind would have slammed on the breaks to come to a stop until the last moment. If I were in the situation, I might have slowed down to 35 or so, but slamming on the breaks on a 55 mph road is just as dangerous as pulling onto a 55 mph road, going slowly, then cutting across lanes in front of other vehicles.

Sorry about your Mav.

Based on the video, the jeep did not even have their indicator on. Get that insurance money and/or sue them. Also, i hope you are doing okay.

Can't really say I'm shocked all the responses that show few people seem interested in putting their own safety and well-being first.

An incidence of "Ugh, what is this idiot doing?" was ignored for an extended duration, entirely mishandled, and ultimately put OP in the situation of an unavoidable crisis. After failing to avoid it by doing the simplest thing in the world: let off the gas completely, maybe brake a little at first (more as needed), and just pay attention.

OP would still have a Maverick parked out front, no pain, no insurance headache.

But also no thread with incriminating video for sympathy, so there's that.

The more I think about it, posting this video, while informative for this discussion, could create evidentiary discovery issues should the other driver suddenly and mysteriously develop “whiplash” and any other medical problems that trial lawyers can have a field over. Perhaps the OP should re-consider this thread and the posted videos.

I would like to point out that this site / chat board is set up almost exactly like the Rivals chat boards where fans of their favorite college teams can bitch about their rivals, rag on the coach etc. Anyway, while anyone can delete their own post inside a thread, only a moderator can actually delete a thread. In other words, the OP can’t delete his own initial post even if he wanted to. Essentially the OP would need to send a private message to the Administrator asking them nicely to please delete the thread.

I’ve seen people make bone-headed comments on a sports board in their OP, then cover their tracks by editing their post to leave a single letter or a period “.” (You can’t leave a blank post.)

It then gets interesting when people quote the OP to capture the OP’s original comment for everyone to see. Sorry to digress, just wanted to share some message board tips.
Deleting the video from youtube and removing this thread would be pointless. OP indicates he turned to video over to the police. Attorneys, insurers, etc, won't need to search youtube or chat forums; the evidence is easily accessible.

Forgot about that…. My post was lengthy but I was just responding to a previous poster to make the point that only a board moderator can delete a thread

Oh yeah, for sure. There are MANY pieces to this puzzle that are flawed. You can pick where you'd like to start.

I personally like to stack the deck in my favor, with things I can control. The better trained I am, the better off I will be. Everyone in my family of 4 has completed a professional drivers training course at a minimum, and I went through several rounds of advanced training for my job. I'm convinced this is the best preparation within one's own control to do, if you spend any time at all behind a steering wheel.
