In my state, any driver rear-ending another car is about 95% always guilty. Jeep lady really caused the accident, should get tickets for at least 3 violations, but OP driver could have easily prevented the collision by being a defensive driver. When other drivers, like the Jeep lady, are on the road you have to drive defensively...much less headaches.

Emergency braking may have been TURNED off OR his Maverick camera was pointing towards the open lane so not seeing the stopped Jeep. My Maverick has executed "Emergency Braking" at least 3 times...each time it was where someone slammed their brakes on when switching lanes.

It seems like the OP was driving too fast for conditions (and admitted they were driving over the limit... which is ALWAYS too fast regardless of the conditions).

It then seems OP failed to yield to the vehicle in front of them and didn't even try to brake until the very last moment.


Sorry OP. IANAL but my verdict is that you're at fault somewhere between 50-100%.

Jeep may or may not have been trying to initiate an illegal u-turn, the video doesn't provide any evidence they were.

To a layman/bystander it looks like they tried to switch lanes when they saw you coming up fast on their rear end.

Had you either maintained your lane or simply slowed down this accident could have been avoided - or at least been more clear who was at fault.

I feel for you. A busted Maverick is no fun and I'll concede the Jeep driver is probably a jackwagon.

The real problem is cultural though, we believe that driving is an American right, only to be revoked, on a temporary basis, on the absolute most extreme exceptions and even then when people are caught driving with revoked driver's license the punishments are typically no more than a slap on the wrist. Was just watching A&E for example, and the cops were so proud of themselves as they pulled over a guy that had fake paper plates, no registration, revoked driver's license, and weed in the car, but because he was super honest they let him go with a warning. Then you have a pilot's license by contrast where revocation is pretty much guaranteed for lapses in safety, totally different culture and not considered a "right".

IMO we should implement the same driver education and testing as they have in Germany, and when people are caught with revoked license for repeated drunk driving and what not, unless the vehicle was declared stolen (in which case driver is arrested for theft), the vehicle gets impounded and auctioned off with the funding going to fixing the roads and more traffic enforcement. If that means that there are 15% less drivers on the road, great! Also need more enforcement of hit&run. Here in TX the drivers almost always flee the scene, because as long as there isn't serious injury its just a misdemeanor charge punishable with a fine but rarely are they caught and even more rarely do judges try to enforce the penalty as they'll either get out of it by rescheduling repeatedly until the cop doesn't show up which is immediate dismissal or say they don't have the money and need the car for work in which case they usually just get probation.
I sort of like the auctioning off the car idea for drunk drivers, but it will cost taxpayers a lot in the long run. If the guy can’t get to work, now you are looking at taxpayers footing the bill for long term food stamps, housing assistance, Medicaid, utility discounts, and depending on the state and unemployment rate at the time, six to twelve months of unemployment. Now if it was just a single guy who was a drunk, would be no issue if he wasn’t eligible for those giveaway programs, but if there are children involved, then you can’t penalize them. Hopefully as the country moves to more and more people working from home, there will be less drunk drivers on the roads.

I don't think so lady, not with video evidence. LOOKs like you were merging into the left lane AFTER right turn into oncoming traffic without checking first ....... PFFFT!!!!

For those on the fence on a dash cam, the Viofo A119 is a good forward-facing starter cam and can be found on Amazon for around $100.

Funny thing about dash cams and wide angles, things look farther away than they are! Also, for all the preaching Karens, Im pretty sure that at some time in your past, there was a car that pulled out in front of you where you had two choices; Slam on your brakes and stay behind the person who just pulled out. Or change lanes and execute a pass fully expecting the other person to accelerate and stay in their lane. And I am pretty sure you passed at a high speed differential just to make your point. When there is a hundred decisions being made in a fraction of a second - I think this person did a pretty good job and tried to find a way past. But the other driver was pretty good at making their car two lanes wide.
I’m very sorry this happened to OP. I’m glad everyone is okay. I hope negative posts won’t keep the OP from posting updates. We can all learn from this experience, especially if the OP continues to share news about the insurance claim, repairs, etc.

But still a completely avoidable accident.

I learned when I had Drivers Ed when I was 16 in Iowa that we needed to drive defensively. In Iowa a lot of people pull out in front of you unsafely and do not get up to speed quick enough. Some also do what the jeep did and change lanes unsafely.

In 1971 the Drivers Ed class used simulators that had you in a seat with a steering wheel, accelerator and brake pedal along with turn signals. In the front was a screen showing various driving scenarios.

One looked just like what happened here with the jeep (vehicle enters road in front of you at much lower speed than you and then changes lanes).

The other drivers in the simulator test who tried to do exactly what happened here failed that scenario.

What we were taught was observe the road ahead. In this case spot the vehicle entering the road and start to slow down and don't try to pass an erratic driver at any speed much less at full or over the speed limit speed.

Most schools don't have DriverEd and it shows in the accident rates, hence the auto makers and insurance companies demanding OEM safety systems to save us from ourselves.

The jeep driver is at fault and a complete idiot. I hope the OP gets fully restitution!

I may be in the minority here and I sure as hell am not excusing the Jeep driver for the asinine attempt at an illegal U-turn, but I would argue that the accident could have been avoided if the OP was driving slower, given there was an obstacle in the roadway. There was no reason for this Maverick to rear-end the vehicle.

Many of the other replies have said that in their states, the one who rear ends another vehicle is at fault and I think any good lawyer will fight the Maverick owner for responsibility on this basis. If they determine a percentage of "at-fault", I would say that the Jeep owner is maybe 10 to 25% at fault.

I think BOTH drivers should be issued citations for unsafe driving including the U-turn attempt, speed and maybe even an unsafe passing attempt by the Maverick owner. The Maverick owner better be hoping that he or she doesn't get sued for injuries on top of the vehicle damages.

EDIT: BTW, I do not think its fair to say that the OP was "HIT"; he or she obviously ran into the other vehicle. Just my two cents. 🤷‍♂️

Ok, wow, I prob should have clarified. This stretch of road has a posted 55mph limit, I was not going much faster than that. This Intersection was recently blocked off to prevent this exact occurrence, but instead, most people go around the barrier, like this person did. IDK why I'm surprised by people blaming me for this, but it is what it is.

The officer on the scene, after watching the video, confirmed I was 0% at fault in his opinion.
Good for you that you are in Massachusetts.

In California....the person that rear-ends someone is ALWAYS at fault.....circumstances be damned. Period. End-of-story.

That Jeep driver was an idiot......

Thankfully, you were only going 75-80 before you hit the brakes. Any faster than that and it would have been exponentially worse.

I hear this a lot, and yet just at the Home Depot by my office every day there are a bunch of guys that have no car and yet have no problem finding work without even the advantage of speaking English. And if you're making above minimum wage, you use a bus or bicycle or an uber or carpool or something. You also are ineligible for unemployment if you were fired with cause, at least in Texas. It would be inconvenient, which is kind of the point, too many softies in America. If I were queen, I would implement Judge Dredd rules.
