Windward has been telling me 3995 markup from the jump and they claim they are the lowest. Thinking about ordering from west coast and having Pasha deliver. The markup out here is frustrating.

Check with your atty but IMO basic business law tells me the dealer's order form (Offer) + Your signature (Acceptance) = Contract.
If the order form ("DORA") is a binding contract, then ask yourself:
  • Why are people with an order form (DORA) reporting getting price-bumped by the dealer?
  • Why aren't people with a fully signed Buyer's Order reporting getting price-bumped?
Here's my suggestion... It's because a DORA is not a binding contract, but a Buyer's Order is.

Once again, it’s plain and simple. When you order a vehicle, leave a deposit and sign a sales contract. Some dealers are honest and others are sleazy, with a contract they can’t pull that BS.

Or better yet rewrite the franchise laws/rules so they can control or even fire these dealerships.
BINGO! I totally agree. Dealerships are an outdated concept. We need to enact laws that allows automobile manufacturers to sell directly to consumers. With the current market, finding a dealership that sells at MSRP with no mark-up is becoming increasingly more difficult. Good luck!

Well can't say forgery, because he hasn't produced the forged build sheet with the 2 items on it, YET! Or did you mean they going to claim I'm forging the 2 signed forms at the true price? lol. And I do have a Lawyer but I'm not taking things there YET!
Your lawyer might give you a free or low cost "consultation". Won't hurt to ask...

@jrhawaii that Hawaii Market Adjustment has gone up over the years. I bought an Expedition from Windward Ford in '86. The HMA was $2,000. Every dealership, for all brands, had it and none would budge.

You stated, "Just was hoping someone on here, hears and has power with the right people or could provide assistance while I wait for Monday to come. " Plenty of people gave you advice to start the social media bashing. That is what you should start today. Call the dealership and let them know you will be complaining direct to Ford about these additional charges that weren't disclosed when you ordered the truck.

If you post the name of the dealership then several of us forum members can help with the bashing. As a fellow Maverick Truck Club member I consider you a good friend and my post would state that, xxx Ford dealership ordered my good friend a Maverick for MSRP as agreed. It is about to arrive and now the dealership is adding over $5,000 of additional markup! Be careful doing - or just don't do - business with xxx dealership.

If they get straight with you we can all delete our posts or edit them to show the dealership returned to good faith dealings.
Do Hawaii dealers pay more to get their vehicles?

If not, that sounds like obvious collusion, as normal free market reactions would be for one dealer to reduce the markup and get way more business.

Seems ripe for a class action suit.

1- Explain that you had a salesman agree to MSRP plus tax, dmv, and doc only.
NOPE. Salesmen never agree to any price, ever. That's management's job.

2- If they give you some line about everybody paying a markup, say you’ll be getting in contact with your attorney today.
They will laugh at you. No attorney would take this "Case" without first having you pay a nice retainer, AND explaining to you that you don't have a leg to stand on.

3- The truck has your name on it and they cannot sell it to anyone else.
NOPE. The truck belongs to the dealer. They can do whatever they want with it.

4- They also don’t want to deal with a court date.
LOL, ok. There will be no court date. Even if there was, they have an attorney on retainer, it's no skin off their ass if you want to waste your time and money in small claims court.


Go to the dealer with the signed papers and speak to the GM only. Explain that you had a salesman agree to MSRP plus tax, dmv, and doc only. If they give you some line about everybody paying a markup, say you’ll be getting in contact with your attorney today.

Learn and document the names of the dealership team -- sales associate, sales manager, dealership's general manager, dealership's owner. Email the GM with copy to Ford. If no reasonable response, in a few days, contact Ford and open a formal case with a tracking number.

Yeah, the Ford dealers there are apparently all in bed together, which is not surprising.

Shell games, deception, collusion, it's their business model. To some degree, it's perpetuated by weak, gullible, uninformed or impatient customers.

Class action suit? Probably not a remedy.
