Order Canceled by Ford per Dealership

Hi all,

Apologies in advance if this is not the right place to post, or if others have hit the topic. I wanted to see if this has happened to anyone else, or anyone have insights on how I should address it. I'm pretty annoyed right now with Ford or my dealership, and I feel like I'm not getting an accurate story.

I ordered the 22 Maverick Lariat hybrid on 08/16 at my local dealership. Paid the deposit and signed the order forms. Fast forward to 01/05 and I emailed my salesperson requesting an update on the order. Coincidentally, he texts back two days later that Ford had cancelled my order due to a lack of material supply. I found this super coincidental since he claimed Ford has "just" reached out to them, and he even noted the timing of it. I was frustrated, but all they offered me was a refund of the deposit or converting to the EcoBoost. They are claiming this happened to several other customers of theirs (see attached photo of the text he sent).

Later that night, I decided to call Ford corporate and see what options I had. I called the 1-800-334-4375 who identified themselves as the Maverick Marketing Team. The rep I spoke to stated unequivocally that "Ford doesn't cancel orders" and she has heard nothing about order cancellations. She looked up my order and indicated that "it shows it one system, but not other other." She couldn't provide any detail and simply stated she would be escalating to management. She advised someone would reach out within 48 hours.

Fast forward 48 hours - still no call. I am not leaping to any conclusions, but based on her remarks I'm being led to believe the dealership either (a) didn't place the order, or (b) messed something up along the way. Anyone have suggestions on how I handle this? Do I just have to bite the bullet now and try again in the 2023 order bank? All help is appreciated.

EDIT: I see now many others have posted on this. Not sure why I couldn't see them when I looked earlier. I guess I'll use this as a post to update what Ford Corporate says if/when they reach out.

Sounds like they did not submit your order correctly and now that ford is not accepting any more hybrid orders until next summer, you're SOL... Sad all these dealers are lying about it rather than owning up to their mistake.

Or the evil greedy dealer option. No Hybrid for you, but dealer gets the vehicle and marks up the price. Win for the dealer, loss for you.

I would definitely push the dealer and keep in contact with Ford to determine which of these scenarios is true. It is definitely one, or the other. Once known (hopefully just the incompetence/missed processing is the issue) it is up to you to decide whether they are worth continuing to do business with.

If it turns out they are trying to get that order into their hands to mark-up, while I would try to get my truck you'd still be heading into a bad transaction from start to finish - up to you to decide whether that hassle is worth it.

I have had my time with the “maverick support team”. I firmly believe they escalate calls to get you to hang up. It is very unlikely you’ll ever get a call back.

[The following is based on the assumptions that you have a signed contract, that the dealer is not telling the truth about cancellation, and that you can get something from Ford contradicting the dealer. If any of those is not right... well, just ignore me.]

On these facts, you may well have a consumer fraud claim as well as a contract claim. Both you and the dealer have legal obligations under the contract and the dealer is making false statements to get out from under those obligations.

It would be worth contacting your state's AG in that case. (After first telling the dealer that you have the sale paperwork, their "cancellation" text, and Ford's statement that there have been no cancellations -- and that you intend to go to the AG's office to complain about it. Who knows how they will respond?)

FYI, I don't usually recommend this course of action. Most of the bad dealer stuff I see reported here seems slippery but not legally actionable to me. (Often because the dealer didn't put the false statements in writing.) But here you have written proof of the false statement that the dealer is using to try to deny you the benefit of your bargain.

Sounds like bullshit to me. Push them. First thing I'd want to see is proof the truck was ever even ordered.

Dealer placed order in WEBDO, but did not finalize order in ROVP (Retail Order Verification Program) with a copy of your signed order and ID, proving it was a retail order for an actual customer. This is totally a dealer screw-up and I would call them on it.

If you really want a hybrid, you will either have to wait until August 16th to order it for a my23 or if your dealer has a lot of hybrid orders in the system (doubtful, since they screwed yours up, they probably screwed everyones up), you can ask to be put #1 on a waiting list if someone declines when theirs comes in. I would definintely follow up with Ford to get whatever good-will they are willing to offer you.

If you are willing to take an EB for the short-term, I would get the dealer to cut you a pretty good deal, then order your Hybrid somewhere else in August and trade the EB in.

UPDATE 1/10/22: After reaching back out to Ford Corporate and the dealership management, here's the final pieces of information and admission I received. The order was in fact cancelled by the dealership because the New Order Manager believed my order was not going to be built due to claimed "material shortages" for the Hybrids. I found this reasoning to be a little weird, but nevertheless, he admitted fault in cancelling my order. Consequently, corporate indicated very clearly that my order was approved for build and was set to go into production before the dealership had canceled it.

So - the new order manager there has admitted fault and apologized. They are looking offering me 3 options at this time:

1. They are trying to work with a corporate rep to get the order back into queue for a MY22. They were very up front in stating this may not be possible, but they corporate rep is going to do everything they can to try.

2. They are going to start contacting Lariat customers to see if anyone is backing out of the order at this time. If so, they will modify that customer's existing order to mine and put my name in its place.

3. If 1 or 2 fail, they will offer me "reasonable compensation" for the MY23 for the errors and delay on their end.

I indicated I'm acceptable of all three, so long as no. 3 is genuinely compensable for the price increases Ford how now implemented on the various features I wanted. For example, I saw the luxury lariat package has now went up by several hundred dollars, along with the moonroof/sunroof. So... we shall see...

I appreciate all the great feedback. Thanks again. Hoping everyone else in similar shoes can get theirs resolved.

Two weeks ago, my salesperson called and said he had a Maverick XLT that a customer decided he didn't want and that I should take it as he was hearing that that my order could be on the chopping block. I declined, since the truck did not include items I wanted. I then called Ford and asked if they had my order and if it was possisbly being cancelled. The person replied that since it was a retail order and not a dealer fullfillmet that it would still be built. Last night my salesman called and stated that my order was cancelled and I could come and get my deposit back. Not really sure how Ford would do this as I have a signed sales contract. At any rate,I plan on contacting my States Consumer Protection Agency and a local News station to investigate this nonsense. Probably nothing will change, but I might feel a bit better.

Hey,

I would call Ford back and ask them if they would kindly call the dealer with you, for a three way call. Your dealer is lying to you. So rather than just going on the defensive, I would fight first. If Ford already confirmed your order, you're good (except you have to deal with these clowns at your dealership). But many times just having a corporate representative on the phone will cause them to straighten their course.
Local news channel is another viable option. Just have to expose them.
Also, there was a video last night about how to fight, w some tips. In addition to some threads here with people that were able to get their dealer shenanigans resolved.
