I pay 1200 a year via state farm, i have an excellent driving record - 250 ded for comprehensive and 500 for collision and I have some reasonable (I forget exactly) medical coverage. Oh, and I'm old! lawyer billboards? all over the place - same with tv commercials. Michigan went with no fault because court cases took forever. The only thing about the ins co going after at fault persons in regular insurance states is that there are some who don't have any assets or a job so you can't really get any $ out of them.

Recently one of the forum members was hit by somebody who only had property damage coverage of $5,000. I want to say it was Progressive. It was still considered he had insurance.

The shop updated the damage assessment and the estimate is now over $5,000 as of today. I found this out because Progressive called to tell me that it's my problem now because their client has only state minimum liability of $5,000 for property damage.

Hope all is well.
Now comes the disappointing part, finding out the insurance will screw you over on the replacement claim.
Hire an attorney to protect you. I hate attorneys but they have a place when it comes to protecting what's yours.
You may have to go after your own insurance once Progressive settles with you. We had Farmers and had to sue them for non/under insured motorist coverage in Calif. The wife was hurt pretty bad. Even your own insurance won't protect you. Our attorney called it "Bad faith" and that woke up Farmers Insurance. Didn't stop them from forcing us to file suit, go through depositions, etc.

Doesnt hurt to get a dash cam. You can get decent ones on Amzon for $30 with sd card, wifi app and all

this happened to my friend’s jeep gladiator a few weeks ago. The white CUV had red light and had the nerve to say “I had green”. My friend said “ all good, I have my dash cam”

police officer said “yup that’s an easy case”

my friend went to an injury lawyer. It was him, wife and two kids in the truck when it happened. Also had a witness that said, the CUV had red light. Both drivers have State Farm and my friend's truck is totalled

Luckily just lots of bruising and lots of body aches and pain. We kinda laugh about it now.. he said his son was about to eat McDonalds pancakes and when they got hit, his son had pancakes and syrup all over his face and hair.

Glad everyone was generally ok. I know all about the bruising and soreness! I can see that being a funny story now it's in the past.

Sorry to hear about the accident but glad you're ok! I just went through a similar situation myself. A women pulled out in front of me and I t-boned her Jeep Liberty with my 2017 Hyundai Elantra. I was traveling at 40 mph. My Elantra was totaled, cops gave her 2 tickets. First off, it took me a month to get the check! Secondly don't take the first offer the insurance gives you. Tell them you'll contact an attorney if need be. Fortunately, with all the headaches it caused me, I was able to find a leftover 2024 Maverick XLT FX4 w/4k tow package. It was everything I was wishing for since they came out. Color and all! Added bonus was the Leer low profile cap. (And yes, I prefer the 2024 over the 2025 refresh, just my preference) Hoping you recover quickly and find another Maverick to suit your needs!

Ooh nice! I was trying to do that next year but I'm not complaining happy I was just bruised and sore and finally got the Maverick I wished for

And that is why I am glad Virginia did not adopt no fault. The bad driver should have to pay for their recklessness. When I moved to Virginia the local insurance agent did a review and said I didn't need uninsured or under insured motorist because "it is a law that all cars have liability insurance in Virginia." My retort was "it is also a law not to shoot people but it happens every day in Virginia." 2 of my kids had vehicles totaled by drivers with NO license or insurance in Richmond. I was rear ended while in another state in 2011. My insurance said " take it where you want for repair, get a rental, and we will get the money from the at fault driver." Not 1 penny out of pocket and it turned out the other driver had good insurance that paid without an issue.

New Mexico is also NOT no-fault.
