This is the kind of thing that actually gets dealerships in trouble with Ford. How dumb are these guys? The customer had the Vin. It's not difficult to confirm what they did.

At the very least, they owe that $5k mark-up to you. I would be very surprised if the GM doesn't agree to that on the spot when you show up with the evidence.
I suspect FoMoCo will take no action against the dealer. Might be a waste of time to contact them.

In their view, the dealer owes the OP nothing. The GM will likely admit to nothing. At the dealership level, it's all deception and shell games. It's their business model.

This is actually one of the few things that really upsets Ford, because it's unfair to the other dealerships. This one basically got a stock order and pretended that it was a customer order. The stealing from the customer things is just icing on the cake.

Nothing upsets ford about the dealership model. The lying, the poor business practices, the overcharging by adding packages not wanted or adding ADM to msrp. None of will change, if ford wanted it to change they would do something about it. Their actions suggest they don’t care.

Nothing will come of this except wasted time, energy, and added stress if you pursue something. The house always wins.

These mf's should pay! I hope OP takes the next steps to hold them accountable. Present all your correspondences you have with these scum bags to Ford corporate. It won't take much for them to see that they strung you along long after the vehicle sold on 1/12.

A similar situation happened to @GreenLady when a dealership said it was "damaged beyond repair" but actually sold it to someone else.
Difference is she was trying to buy one in transit (someone else’s canceled order) that was being “held” for her. (IIRC)

The OP actually placed an order for this vehicle months ago. This was 100% his vehicle to purchase and I can’t imagine how the dealership could get away with this. I could see them trying to charge the OP over MSRP when it arrived if he didn’t have a signed buyers order with a price (which would still be a terrible thing to do), but telling him it never arrived and then selling it to someone else with a $5k markup? They can’t actually be that brazen, right?

Add to the fact they were stringing him along as recently as 2 days ago before he finally just gave up and got his deposit back. The truck was sold a month ago!

Yes, and according to the Gary Yeomans Ford - Daytona Beach website, it appears that the salesman and sales manager are still employed there. Business as usual...

If the OP is correct and they did that to me I would find a way to break if off in their ass. Do your homework, assemble your paperwork, dates and other correspondence and start with the dealership owner, Ford corp and up the food chain until you get answers.

I submitted my complaint to Ford Corporate and they have opened up a case. The operator told me it goes up to her superiors and then the regional managers. Added my phone number so if they need more information they can call me back.
