It is at the dealership! I grabbed some pics this evening after they closed. They had a ton of new vehicles come in and mine is just waiting its turn. Still had all the plastic wrap on the interior.

Explorer stays, even if I can't take home right now. They wanted me to take a $16,000 loss on a vehicle I've never driven. So, I will be taking the Escape down for them to look at.

Outcome of that trade offer will determine whether I continue with this forum...

Do the lemon law, get Ford to take it back...doesn't hurt the dealer...

HOLY COW. I thought that might happen and I agree with lemoning the Explorer.

However that takes time that you do not have. If you don't take delivery on the Maverick they are going to sell it. Maybe not in a day, definitely (in my opinion) within 1-4 weeks unless they have it marked up way too high.

I would be so extremely pissed at that dealership. They think they have you over a barrel and they're intent on getting the value back out of that loaner they apparently never really thought you deserved. When you kept talking about loaners, I honestly assumed your dealership was treating you right this whole time and I would guess you did too.

Seriously, I doubt renting a vehicle for the time you couldn't drive the Explorer would even cost $16,000. They are really trying to exploit you.

Their position isn't unwarranted. Salesman is salary and he asked the sales manager if they could call Ford. But it seems it is a Ford dictate on how to treat the Explorers. As a dealer, they can only do what the used market allows and the used market is way down for Explorers (I wonder why...). Salesman said even his F-150 is $17,000 under at the moment.

They offered $4,000 over what KBB reports as the trade value. So, its not like they aren't trying. Maverick sale is another allocation and they have sat on a few EBs recently. So, they are incentivized to sell it to me.

Lemon Law would require Ford to buy it back as dealerships are immune under Alabama law when the vehicle is new. As you all recognized, that takes time and I would not expect them to hold onto the Maverick that long. Ford (the manufacturer) has to be given an opportunity to fix and by the time the paperwork makes it through the courts, even Ford will have it fixed.

However, I do plan to ask a point of order: if the Explorer is counted as "in my possession" for the purposes of trade, then why can it not be counted as "in my possession" for the purposes for driving it home? If I did decide to take the $16,000 eat, the Explorer is now "used" and there is no stop-delivery on used Explorers. Meaning the guy right behind me can take it home.

I'm sub-$14K on the Escape and KBB is reporting a basic $18,000 value before any dealer credits (as I see they have $4,000 to play with. While I prefer the idea of the Escape being paid off in the nearer future, the numbers may end up making sense.

Three weeks. That's all I needed a new vehicle for this summer. Point of getting the Explorer was to have it available for those weeks.

Lessons learned:
  1. Never buy something with an active recall on the promise it should be fixed soon (even though I still don't know why it is taking Ford this long).
  2. Rent what you need for when you need it only.
Whatever ends up being my final cost, I'll mark it up as a stupid tax...

congrats, man. now to just deal with the Explorer drama, that won't be fun but at least (to me) it seems straightforward.

Salesman gave MTC a shout out (likely my fault). But I don't blame him or this dealership. Ford has tied their hands. In fact, when I told him if I traded the Explorer, next guy could drive it off, he laughed out of exasperation. Even he is tired of Ford's crap.

Salesman was awesome. Interest rates are stupid compared to last year, but that was a known item. I got the Explorer at 3.9% as a incentive. Nothing was topping that.

ZERO markups or doc fees. Just tax and title. Gave me $5,672.69 worth of equity on the Escape to apply to the Maverick.

Obviously, I am frustrated with the Explorer experience. But the salesman and a couple other staff absolutely shared in that frustration. For one thing, the Explorers are taking up space! Another, they offered that that Ford should just buy them back. But Ford's position to them was, "you shouldn't have sold them at the 3.9% incentive we were offering." So, they're sorta stuck.

I won't ever buy a vehicle I can't drive home that day ever again. But the Maverick experience has been outstanding.

Congrats, happy to see the Maverick finally in the driveway! Now time to deal with the Ford Explorer nonsense. No wonder they're not so hot in the ratings. :cautious:
