The real issue is testing and documentation. CVC 26101.b says that aftermarket lights have to meet the criteria in 26104.aAnd if they're visible at a thousand feet to the rear doesn't matter if they're smoked or not.
26104.a says that before offering the product for sale, they have to lab test the item and have the data available to prove that their item is in compliance with the law. That is why the spray-on films are illegal. There is no way to get test data since each tail light shape is different and each end user can apply a different amount of spray.
So as long as they do the lab tests before offering them for sale, they should be legal.
