Very much not happy.

After waiting for build, and then through ford holding it hostage for quality hold, I was ambushed with an arbitration agreement at the closing.

I was close to walking over it. If it were for me, I probably would have walked, but it was for my wife, who would have been rather upset if I had.

I think the arbitration thing is very common in many contracts these days.
Nobody wants a court battle except for the attorneys.

Pretty standard from dealers these days. Certainly wouldn't make me think of walking out of a deal.

Practically standard procedure nowadays with any vehicle brand you purchase. If it’s not in a separate doc it will likely be in the fine print of the other stuff you sign.

I'm guessing.
The OP is pissed because at closing the purchase contract contained an arbitration clause.
Meaning, the buyer/purchaser is
agreeing to arbitration, giving up their right to litigation.
Now, whether it was Fords or the dealership arbitration form I don't know.
Businesses now don't care. It's their way or the highway. When everything nowadays contains an arbitration clause, you're going to be signing one wherever you buy.

Thank you for clarifying. I ordered mine Nov 2023 with a down payment with a $1K down payment, and the PO did not have an arbitration agreement. I don't know if it's because my dealer has an excellent reputation in our community or if it is something that became standard practice since then.

Very good chance whatever you signed had a clause for arbitration. It just take a couple sentences. It’s not an entire separate legal contract.

I don't like the arbitration agreement in general, and particularly the waiver of class action (so that when, say, it turns out that this year's Velocity Blue paint is even worse than the late 90s metallic green, and goes bad quickly, there won't be a class action to get them all repainted, but rather each individual has to deal with the whole rigamarole--meaning that many won't, which is kind of the point).

It's the sandbagging part that really makes me angry.

The agreement is a "material" change in terms. It was not disclosed until most of the way through the closing papers, months after I paid the deposit.

It also has a paragraph that conflicts with the rest of it, claiming to leave small claims available (which, in most states, can only award damages, not order action).

What does that mean?
My wife's heart was set on finally getting her truck; she's wanted one for forty years! If after all this wait, and the further month after the scheduled delivery once it built, it didn't happen, she would have been quite unhappy.

Had it been for me, not her, I probably would have walked. (and been sorely tempted to sue for specific performance . . .))

Certainly wouldn't make me think of walking out of a deal.
It likely wouldn't stop me from entering a deal--but not until I checked with other suppliers. But at closing, it's no different than changing the price.
