Let’s say that a log came rolling into the street. Yeah, it’s not supposed to be there, etc. But because it’s not supposed to be there, do you barrel forward citing your “ right of way “?

There’s an obstacle in the road, a moving, idiotic one at that, but one would have to question the way this driver approached the situation. When I’ve been in an accident I’ve always been asked if there was anything I could have done or did I do anything to avoid the accident.

I did not see any defensive driving or effort to avoid the accident. No hate, I feel bad for the guy and his new truck but I just don’t feel he is 100% absolved of blame here🤷🏾‍♂️

Regardless of how much fault you want to assign to OP, way too many on here (and the roads) can't seem to understand the concept of accepting responsibility for their own safety and wellbeing, and that of their passengers.

If you can prevent a crash by simply paying attention, being proactive, preventing a situation from escalating into an emergency, why do y'all not understand that should be the "choice" made every single time?

Who cares about fault determinations by both police and insurance companies when you can prevent one from being needed? At best, prevent the headache and hassle OP is going through. At worst, prevent serious injury or worse to you, your passengers, the other driver, and their passengers. It's the only option. Anything else, find someone else to drive you.

Can't really say I'm shocked all the responses that show few people seem interested in putting their own safety and well-being first.

An incidence of "Ugh, what is this idiot doing?" was ignored for an extended duration, entirely mishandled, and ultimately put OP in the situation of an unavoidable crisis. After failing to avoid it by doing the simplest thing in the world: let off the gas completely, maybe brake a little at first (more as needed), and just pay attention.

OP would still have a Maverick parked out front, no pain, no insurance headache.

But also no thread with incriminating video for sympathy, so there's that.
The problem is, the jeep driver turned into tbe right most lane, then without an indicator moved over to the left lane and attempted to stop in the middle of the road to take an illegal u turn. As the jeep was turning into the right lane, sure the maverick driver could have let off the gas, but realistically they aren't at fault for keeping on the gas as they decided to go to the next lane to avoid the slow car. The jeep ABSOLUTELY SHOULD NOT HAVE WENT TO THE LEFT LANE AFTER TURNING INTO THE RIGHT LANE REGARDLESS OF AN INDICATOR OR NOT. They did not make sure the coast was clear to change lanes, which makes the jeep driver 100% liable for all damages.

Did you intentionally just disregard my entire point?

It doesn't matter who would be liable if you protect yourself and your passengers, never mind your vehicle.

I did partially disregard your post because first off, I am pretty certain the OP did let off the gas based on the video, and secondly, they had the car for about 1000 miles. They might not have known how far to push the brake pedal in an emergency especially if that was a hybrid maverick and maybe they came from a gas only car. Because the braking has a very different feel for hybrids. Im giving the OP the benefit of the doubt that they were still getting used to the truck, and never did a hard brake in that truck before because the car braked lightly, and it was possibly only using regenerative braking at that time. Not for me to assume, but i was just giving the legal aspect of things. Yes, avoiding an accident is the best way to do things, but tbh based on the dashcam video, you can say the same thing to the jeep driver too, because they ultimately caused the accident due to their negligence.

Some folks will just never understand the "safety first" mind set.

The poster above literally said op "could have let off the gas..." (nevermind braking) but then goes into some tangent about how they shouldn't have to drive defensively and that the less safe option was a perfectly reasonable choice (nevermind that it nearly totalled the MAV).

You can't argue with people like that. You just gotta hope you can avoid crossing paths with them on the road.

I keep telling myself to get a camera. This might have put me over the top to get one now. An illegal u turn and they try to argue it was your fault.
It's not hard to install garmin mini 2 is a good choice for cheap small and works.

🤷‍♂️ I don't get it.

The problem is that when people have mindsets like that, nothing you say or do will change it. There's no convincing them. I literally advocated for taking responsibility for your safety and that of your passengers, and the first response I get was "but but but OP probably didn't know how the brakes work", while OP admits to speeding. What is that nonsense?

We're not going to change their minds.

Like when someone wants to engage in road rage. I know nothing I do will change their mind. All I can do is safely get away from them.
