Most schools don't have DriverEd and it shows in the accident rates
Not having Driver Ed now has kids learning bad driving habits from their parents.
Then the kids take their learned bad habits add new ones and pass them on to their future kids.

Which now goes like this: DUMB -> DUMBER -> DUMBEST and on and on

Hence the auto makers and insurance companies demanding OEM safety systems to save us from ourselves.
Actually it is more us as customers asking for safety features for both us and to save us from others. I welcome safety systems being mandated on new vehicles that are proven to save lives.

That is why I opted for the Co-Pilot360 option as it can help me be safer in parking lots or in passing. This option was not mandated but I wanted it.

The jeep driver is a complete idiot.
True that the jeep driver is a complete idiot but this accident was avoidable so I do put some blame with the OP as if he just followed basic defensive driving steps no accident would have happened.

In California....the person that rear-ends someone is ALWAYS at fault.....circumstances be damned. Period. End-of-story.

That Jeep driver was an idiot......

Thankfully, you were only going 75-80 before you hit the brakes. Any faster than that and it would have been exponentially worse.
Someone posted on this thread that the speed limit was 55 MPH on this road so if the OP was going 75-80 MPH or (20-25 MPH over the limit) before he hit the brakes he should not get a free pass as to no fault from him.

Since I'm 72, I know how old people drive, I think I've seen it all. After several defensive driving courses, I think I would have been on the brakes the second that Jeep entered the road, Too many people rely on their horn now days instead of brakes! I'm sad for you and the Mav. . It did hold up ok, the door looks straight and the corner post at the windshield looks good too. I have always wondered how that aluminum holds up. I also wonder if the cactus grey is harder to see against a sky background for other drivers when pulling out. We all share the road with OLD people, They move slower. Be aware of hazards.

I completely agree.....

Which is why it boggles my mind why the OP would post the video on YouTube and this message board..... Unbelievably stupid.

If I was the insurer and/or lawyer for the Jeep driver...... I would have a field day analyzing the video to determine just how reckless the OP speed was. And use that against him in a court of law.

He would have been smart to show the local cop the video to let the cop assign culpability (OP says cop put him at 0% responsibility....good for OP) and then "sit" on the video and use it if/when it was to his advantage. And "lose" the video if the wrong people asked for it (opposing insurers/lawyers).

Instead.... it is out in the public domain. Kind of hard to put that spilled milk back in the bottle at this point......

OP should have exercised his right to remain silent......

Instead, he chose to scream at the top of his lungs "I AM GUILTY OF RECKLESS DRIVING".

Why?

I hear this a lot, and yet just at the Home Depot by my office every day there are a bunch of guys that have no car and yet have no problem finding work without even the advantage of speaking English. And if you're making above minimum wage, you use a bus or bicycle or an uber or carpool or something. You also are ineligible for unemployment if you were fired with cause, at least in Texas. It would be inconvenient, which is kind of the point, too many softies in America. If I were queen, I would implement Judge Dredd rules.
I am glad I don’t drink lol

#1 glad humans are safe #2 typical jeep driver, no signal and never in a hurry to get out of the way, #3 thank goodness you have a dash cam #4 how many months wait for parts?? #5 that sucks man.

I’ll admit the first time I watched it the accident looked avoidable, then after a few more times I started to doubt that. The Jeep was totally at fault and created a road hazard. I guess the only part I’d question now which nobody has brought up, was that this part of the road and the illegal U-Turns that take place their was known to the OP.
As such I’m surprised they didn’t approach that stretch with more caution.

You are incorrect.. on 2 points, but correct that Jeep driver is an idiot.

There is no state that I am aware of where fault is 100% automatic regardless of circumstances. I live in GA and you would be presumed at fault here, but he has video evidence of the contrary. In CA it would be a "rebuttable presumption" that the driver of the Maverick is at fault. Again, just like GA. He has a rebuttal and can prove the presumption wrong. So no, there is no "ALWAYS" in these situations. Not in MA, not in GA, and not in CA.

Also, I don't know where you got a 75-80mph speed? The speed is not displayed at all in the video that I can see and you cannot determine speed based on what you can see in the video, either. It looks like 55-60 to me just like the OP said, but again, you can't judge speed that way.

Oh, we drink, but before we start sipping on Johnny Depp style mega-pints of red wine, we make transportation plans so we aren't driving. IMO repeat offender DUIs choose to disregard everyone's safety.

This is actually one reason I'm really excited for lane-keeping alert systems, as they nag drivers that repeatedly change lanes without using their blinker. Another pet peeve of mine, next to the DUI drivers in the gulags would be the people that cut me off never using their blinkers. :D 🚓
