I just talked to a local dealer who has a First Edition coming in. They told me they paid the ordering customer $2000 to give it up, and now they have it listed for $10k over sticker
I can't believe they would admit to doing that. Seems unethical on it's face. Maybe it's just business as usual in the automotive world.

I looked, but I'm not seeing any. Please tell us how to find them.

Search for Wilmes Ford on google, then on the information click the reviews and sort by newest. I have attached a few below. All One Star

It is one thing to have ADM on Dealer ordered units, but to do this to someone who waited months is scummy, deceitful, and makes you question what other shady things they do in pursuit of profit margin. Avoid this dealer unless you want to be taken advantage of."

"They'll take your on-line retail order, tell you the price in your order sheet is what you'll pay, and when it arrives months later they mark up your vehicle thousands of dollars. Go elsewhere"

"Ordered a Maverick in July and verbally agreed on MSRP being the price.
After waiting for over 5 months they email to say that it’s come in and they are charging an $8,000 additional dealer markup! That’s over 30% markup! That is pure greed.
The entire point of ordering a vehicle is getting exactly what you want and not paying over MSRP. "

This remedy is certainly well-intentioned and potentially very good advice, but the fact remains that the OP should not have to resort to this to get the Maverick he wants. (If that's even possible.)

Wilmes Ford (Not-so) Superstore needs to honor the original agreement.
100% agree, in the meantime just throwing another option out

I went to wilmesford.com and clicked on "About Our Dealership." Then, I clicked on "Reviews." the latest one I see is from Dec. 5. They seem to be in chronological order. Virtually all are 5 stars.

Am I doing this correctly?

I went to wilmesford.com and clicked on "About Our Dealership." Then, I clicked on "Reviews." the latest one I see is from Dec. 5. They seem to be in chronological order. Virtually all are 5 stars.

Am I doing this correctly?

No, I am not a Webdev, but I would imagine they have ways to only populate that with 5 Star reviews. The source for the list on their website directs to files hosted by dealer.com which is a marketing company, which I am sure only populates 5 star reviews for that page.

I know, I know, I know....... I should have got something signed when I ordered my Mav back in July. I was told in my meeting during ordering that
I was locking in price and would avoid the almost guaranteed rise in value as demand goes up. Waited close to 6 months eagerly checking status of my order dang near everyday. Truck get delivered this morning 12-15-21. Dealership calls this morning to tell me there would be a $4,500 dealer mark up. Being that I am already out of that state due to a military PCS I would already have to buy a $500 plane ticket as well as almost 12 hour drive back to my new home I have decided to back out. So now a beautiful Ford Mav sitting in Altus, Oklahoma at a very crappy dealership of Wilmes Ford. At a awesome $4,500 mark up, which they may change to almost $8,000 as they are telling me they gave me a half off discount on the mark up!!!!!!! How kind of them for thinking of me in doing that!!!! Nope go screw yourself Wilmes Ford of Altus, Oklahoma.

Added in the email I received with explanation.

One final note..... As my wife and I found out about our move to a new state I was in full contact with the dealership. Even looked at price of shipping it to my new home and was quoted at $1,800 for the trip from Altus, Oklahoma to Great Falls, MT. I was in constant contact with the dealer. He had every opportunity to be open and honest that there could be a mark up upon arrival. He did not mention this once in our exchanges. He waited till delivery had happened to let me know. That is why I believe this was his plan all along. To have me walk and sell it to the next guy at a profit. At the end of the day I guess as the buyer all I can do is be mad as they sell my custom order to another inidividual.

Y'all Mr Levine has DM'd me back on twitter. This wrong may be righted after all.

I just saw this. I hope it's not too late to still get the Mav you ordered. This is what I posted on another thread:

I am no lawyer so check with yours about all this to verify my understanding...

Most order forms are only signed by the buyer. That form is the dealer's offer at a specific price. Your signature is acceptance of that price and that price only. Don't let them bully you into thinking the price you agreed to means nothing. A contract does not need to be 10 pages of fine print to be valid.

Basic business law says the order form's offer + your acceptance = contract.

Imagine if you had an order with Amazon but when the delivery truck showed up the guy tells you what you paid is just a "deposit" and if you want him to leave the item with you, he needs more money. This is similar to what the dealers are doing by adding a markup to your order that already has a specific price. Sounds like fraud to me.

This sucks. Question for the group. I have the agreed upon prince in email from the dealer for my order. Have any of you or know of anyone that the dealer would not honor the email? I don't want to thread jack and want to learn from the OPs experience.
A guy posted on another thread (Greediest Maverick Dealerships) that he went to court with just text messages and the judged ruled in his favor. A contract can be in any form, it is an agreement between 2 parties and can even be verbal.

Exactly, picked the mav as my first truck because of the affordababilitlty even with the options, now they are marking it up and its approaching the price point for the bigger trucks.
I’m not a licensed attorney and this isn’t legal advice but if an Oklahoma dealership were to add thousands of dollars in market adjustments to a Ford Maverick order, not only would they potentially violate Ford’s franchise agreement but they may violate the Oklahoma Consumer Protection Act (“CPA”), Title 15, Chapter 20. Number 8 stands out to me for some reason.

15 Okl. St. § 753 reads in part:
”§ 753. Unlawful practices
A person engages in a practice which is declared to be unlawful under the Oklahoma Consumer Protection Act, Section 751 et seq. of this title, when, in the course of the person’s business, the person:
1. Represents, knowingly or with reason to know, that the subject of a consumer transaction is of a particular make or brand, when it is of another;
2. Makes a false or misleading representation, knowingly or with reason to know, as to the source, sponsorship, approval, or certification of the subject of a consumer transaction;
3. Makes a false or misleading representation, knowingly or with reason to know, as to affiliation, connection, association with, or certification by another;
4. Makes a false or misleading representation or designation, knowingly or with reason to know, of the geographic origin of the subject of a consumer transaction;
5. Makes a false representation, knowingly or with reason to know, as to the characteristics, ingredients, uses, benefits, alterations, or quantities of the subject of a consumer transaction or a false representation as to the sponsorship, approval, status, affiliation or connection of a person therewith;

Yes, if the order form and the price means nothing, then the dealer could take delivery and sell it to someone else +10k without even calling you.

Again not a licensed attorney but the penalties may be quite severe for the dealership and maybe even Ford if the case were successful:

Section 753 prohibits false advertising. Under Section 756.1, the Attorney General or a district attorney can bring an action upon knowing about a violation. Under Section 761.1 a private action can be brought by an aggrieved consumer.

Remedies available under Sections 756.1 and 761.1 are:

  • Declaratory judgment,
  • injunction,
  • revocation of license,
  • actual damages and litigation costs,
  • attorney fees,
  • civil penalty up to $10,000 per violation of injunction, if violation is unconscionable,
  • penalty up to $2,000 per violation of the CPA, and
  • other appropriate relief.

at least you guys were told in advance that your car got marked up. i went to pick up my Maverick yesterday, was at the dealer for 3 hours giving them all my life's information before they showed me the final invoice which had $3,165 worth of "Dealer Installed Options" all useless crap (Ding Sheild protection, tire and wheel protection, wheel locks, etc...).

I asked why in the world they added things onto MY truck that I pre-ordered from Ford without my permission/consent/notification and got the standard: "oh all dealers do this, you know the market right now, etc..." They said "take it or leave it we have a long waiting list and can sell this for $10K more than the price you are getting." I walked right out that door.

Got some advice from a family attorney friend, was told to call the GM and see if he can do anything. I called him and he said that he was unaware this happened, is really sorry, and that they should have informed me of the added charges before I arrived to pickup my Maverick. He is "seeing what he can do", but I assume my truck is already sold to the next highest bidder.

I will be reaching out to Ford and the DMV as I was told this falls under bait and switch as I was not informed. I honestly think it falls under THEFT as the dealer stole MY Maverick that I pre-ordered with my specs and then added things onto MY truck without my consent with the full intent of showing me out the door so they can sell it to another customer at an even higher price. Another salesman who overheard everything going on straight up told me "they prefer that you DON'T buy the car because they can make $10K more by selling it to someone else"

Yes they tried to do that to me and I kept saying no. In fact the contract they wanted me to sign stated the extra items were optional. Same with the extended warranty and pre-paid maintenance, all optional. I kept saying no. After a bunch of bullying they finally backed down and I paid msrp like my order form stated.

They wanted you to walk, unfortunately you did them a favor. I believe they have an obligation to get you an exact replacement at the price you ordered, check with your lawyer to verify.

Not a lawyer but take a gander at California Civil Code 1770. If charged California may create misdemeanor criminal charges in certain situations.

Okay, so without reading back over this entire thread, I think we have you all beat !!!
Somebody mentioned a $4k mark up ? Ha ! That dealership must not have had any balls !
When my GF ordered her XLT, we were quoted $23 (+ $3k in tax, license, and CA reg) So they called us yesterday to say they had the truck and to come on down and pick it up. Then walked out with a price of $38K !!! Are you ef’ng kidding me ?!?! A $15K markup !
That began a very long series of back and forths …. 6 freaking hours worth ! At which point, it was still about $2K higher than MSRP. So I finally told them, we were going to go home and think about it. Not surprisingly, they sure didn’t want us to do that ! They finally came out and quite surprisingly, sold it to us for MSRP ! Considering how high they started, I was honestly surprised they came all the way down…

BTW, during our haggling, I actually pulled up this thread on my phone, and showed the title of it to my GF…. Yes, it was my GF’s truck, and her $$$, but I was not about to let her get suckered.

I guess I can’t blame them for trying, but geez ! Who would just say, okay, here’s $12K more…..

Oh btw, we test drove it, and loved it 🙂👍

Mind me asking what dealer this was at? I just got my production date today and am thinking now is the time to get a purchase agreement signed so I don’t chance the dealer trying to do the same.
