I think an upfront relatively small $399 fee is acceptable. They are telling everyone ahead of time that this is the cost of buying from them.
You always have the option to find a different dealership to buy from if they increase that fee to something truly ridiculous.
I also have a 2017 impreza. Wish I had lifted it to crosstrek heights, one time I was being stupid off road and ran my steering motor into the ground pretty hard.
Insurance paid $5000 to repair the damage and make the wheel turn properly again.
Any of those numbers are too close for comfort for me. I have went down below "0 miles" by quite a bit in my subaru and it is nerve wracking the whole time.

I would have expected to test like 50. Anything you are lighting up needs to bounce back to the driver to be helpful. I guess I'm not very familiar with the scale.

That sounds like good advice. It's really great your employer provides you with access to a lawyer, and I always agree with giving people the benefit of the doubt until they prove otherwise.
If you haven't given them a deposit maybe call other dealers in the area and ask them if they can take over the order. This dealer sounds like they are being a real problem for you.
