On Dec 23rd my 2022 Hybrid was hit by an (1) unlicensed driver (2) uninsured vehicle (3) unregistered vehicle (4) left scene of accident. NOT arrested and found out yesterday was charged with Careless and Imprudent instead of "leaving scene of accident". I had followed the car for 20 minutes while wife on phone to State Highway Patrol dispatcher giving current location and finally pulled her over. Over $7K damage so if was charged with leaving the scene it would be a felony, being charged with C&I not a felony. If driver pleads guilty then there is no restitution required by State, if doesn't plead guilty and is found guilty then complete restitution will be required by State.Hope he goes to jail.
I would assume you can still sue in civil court. You are correct. Driver (20 yrs old) and mother (owner of car) both don't have anything but a history of tickets that have been changed to "muffler" violations. My best hope is for traffic Court to make them pay restitution to State Farm which will take years most likely. I'll get my deductible back that way ($500). State Farm was great, truck repair was covered by my "uninsured motorist" coverage so not a charged accident to me. If no restitution in traffic Court I will sue both just for the fun with little hope of getting anything.I would assume you can still sue in civil court. The Bodyshop has a glaring Conflict Of Interest here. If you agree to let insurance pay the bodyshop, he's got a lot of revenue and you are essentially on the hook, have to wait for as long as the Bodyshop takes. You want to explain to the insurance company that the truck is totaled, plus there is a parts backlog. Tell them to give you a letter which guarantees a date certain for your vehicle, and their guarantee against in future problems. Obviously they won't. If you make noise, they might total it, especially if they are on the fence.Bodyshop contacted me and said it looks worse than it is and that im far from totaled. The insurance adjuster is supposed to come do their estimate at the end of the week and match it up with the bodyshops
