Is it a lemone car, what shall I do, can I ask for refund, or switch to another?

Here is what happened, yesterday, I picked this 2024 maverick hybrid xlt, just drove away the lot, the check engine turned on, so I turned back, they said it was issue of battery, need to reset it, because it was disconnected during hail damage repair.

Then I drove away, it was all good until I done my night shift, tried to leave for home, in parking lot, the electric parking brake stayed with yellow light on under it, the car can not drive. I ended up to call ford roadside servic, while I was waiting, the parking brake suddenly can work, then I drove home, informed dealer. I was stuck in parking for 1 hour.

This morning, it happened again, parking brake stayed on with yellow light, now ford dealer tow it for service, they are arranging a transit car for me.

Feel so bad about this, I was looking maverick for a while, eventually pull trigger, bought it with full cash. Now, it is this, lemone car ?

Please advise, thank you !

It's at the dealer. Let them diagnose and decide from there.

Each state has different lemon laws but this probably doesn’t qualify yet because you have not had it fixed and it has not been more than 30 days of waiting for a fix. I filed a lemon claim for my Mav, it was approved for a buyback which I refused, got my truck fixed, and Ford gave me $5k.

Not a lemon - by the legal definition it sounds like you are asking about.

Could it have a strange issue not normally seen - always possible.

Could it have a low battery because 24MY sitting on lot since October and they forgot to charge it - yes.
And doing the Battery Sensor reset at that time would be terrible.
Sets a new low for what the truck now thinks is a new fully charged battery.

Curious though - after the night shift, it did start, but then failed to release the parking brake?

Ya, that's probably something else.

But what it sounds like they did with battery was still not good.
While they have it - they need to charge that battery fully - then BS reset it.
When you get it back - you need to lock it overnight for a BMS relearn.
That's all in your manual.

Thanks, good to know, could you say more of detail, how do you end up to file lemon laws,

While, after you turn on car, it starts, but, when you tried to release parking, it won't do it, no matter what to do. If you put on R, car won't move back, I don't what to push gas pedal to force it.

Basically, it stuck. The towing guy this morning had to life up the whole car to dealer. In the car, we chatted, these electric parking things are sooo stupid, used to mannuel on/off, so straight forward. The tow guy said he had several hybrid cases like this, electric park stuck, car won't move on neutral, make very hard to put on towing because of space issue, also, when car stuck in the street or highway, can not moved either to clear up traffic.

I had the heat exchanger issue and my Mav sat at the dealer for 69 days waiting on parts. In CA, lemon claims are filed through the BBB.

I am getting a little nervous, given it is a brand new car, I thought could be some kind of easy fix. Here is what I searched in google:

An electronic parking brake that won't release can be caused by various factors, including corrosion, freezing, a dead battery, or a malfunctioning servo motor. Troubleshooting can involve checking for debris on the switch, replacing a blown fuse, or manually releasing the brake.

My '25 literally just got dropped off at the dealer for the same problem. They're replacing some sensor (name is escaping me) that basically tells the vehicle if it's in park or not; and therefor whether the ebrake should be toggleable or not.

It took them a week to get the part, but only a day to diagnose it at the time. I'm not sure what they're dragging their feet on.

I doubt it's a lemon in the truest sense. Your ford mechanic needs to do better.

Semi-related, did you get any kind of "service vehicle soon" error? I did, and that triggered the ford app, and I assume helped the tech find the problem sooner.

Also, it's a holiday in the US AND the weekend. You might need to calm yourself a little and call them tomorrow or Tuesday when they're probably back to full staff.

You dropped it off on a Friday and most dealership service departments only have skeleton staff on weekends, if they are open at all. Depending on how busy the dealership is, they may not even get around to it for a couple of (business) days.

I have a 25 AWD Hybrid that had a similar issue. It spent 3 weeks at the dealer. They replaced the electric brake booster. It took two weeks to get the part and then a week for them to install it.
