Hello Forum,

Hoping to gather some information from people with a similar experience.

Hybrid Mav
State: OR
Ins: Geico

9 months ago my 4 month old Mav (4k miles at the time) was t-boned by an uninsured driver. Both right side doors suffered damage. Rear door doesn't work. Current damage estimate is 13k.

Parts have been backordered since I took it in to the Geico-approved shop (mid August). Vehicle is still driveable but the true extent of the damage will not be known until the first wave of repairs happens - which means all the parts have to be in.

For anyone who has been in a similar situation awaiting parts, did your car fall under any lemon-law provisions?
E.g., I am wondering if I can receive fair market value for having it totaled out/salvaged/lemon-lawed...

Thanks in advance for any advice.

Contact several lemon law lawyers in your state since laws vary by state. Most provide free consultation. I'm sure there's others in the same situation as you but again, it varies by state.

Not a lawyer, but I'd imagine you'd be hard-pressed to argue that repercussions from a motor vehicle collision fall under a lemon law condition.

If anything, lack of parts availability can increase the cost of repairs and/or exceed the period following a "loss" (the time that the collision occurred) enough to declare the vehicle a total loss.

That is what was happening when Teslas were becoming more popular. If it is reasonable that the vehicle cannot be repaired within the timeframe declared by the insurance carrier, it can be declared a total loss.

That's what you'll get if your vehicle is declared a total loss. What you won't get back is the amount of time that you waited to get the vehicle.

If your vehicle is declared a total loss, I'd ensure that you get, well, fair market value, which for hybrid Mavericks is regularly above Blue Book or NADA value for a preowned one that has 9,000ish miles.

If you can get the insurance to total it, get a price on buying the vehicle with the salvage license... Then use a portion of the money they gave you to buy a new car and get the thing repaired.

My wife got light hit on passenger side, took new door on passenger front and door skin on pass side rear, had all parts within a few weeks - this happened in November and my truck was fixed in December...I find it hard to believe they don;t have your parts, can they tell you WHAT parts they are still waiting on?
p.s. my doors continued to work, so maybe it is door mechanisms that need replacement? Idk...

I find it hard to believe also. I independently checked with a dealer to confirm the issue.

My hit was pretty substantial. The pillar between the doors was also slightly dented. According to the shop, they need to cut out the entire door area to insure there is no internal damage.

Supposed they are just waiting on one more part, which might be available in 2 weeks.

After that, the repair will take 4-6 weeks. In case the part is not available, I want to explore my options regarding having it totaled since it has not been repaired in a timely manner.

Always request Ford Body shop, they seem to get the parts fast. damaged 23 Maverick, $8300 worth, fixed in a week. Traded it in Damaged. But followed repair.

Always request Ford Body shop, Recommended by your insurance. Had $8400 Repairs on My Maverick, Done in little over a week. I also traded in on New Maverick.
