Surging when cold; is this a potential recall issue?

My 2023 hybrid surges when cold. e.g. when I stop at a traffic light 1/3 mile from home, the vehicle surges ahead unless I press the brake hard. Twice I took it to the dealer, and their response is "cannot duplicate."
I see many posts of identical issues from other hybrid owners. Unless I keep my foot usually heavy on the brake, the vehicle can surge into an intersection. This can be an accident waiting to happen. Is it time for Ford to issue a recall?

My 2022 would "surge" while stopped at a light. November of 2022 they came out with a fix to the Anti-lock brake system module. I had mine reprogrammed by the dealers mobile service in January 2023.
