Dealers double dipping?

I happened to find a maverick on the lot and put a deposit on it immediately. I called today about the gas tank recall and they told me that someone had actually already out a deposit on it before I did so it's technically theirs. I could probably be more upset about it but what I'm suggesting is what's stopping dealers from marking up vehicles and basically selling to the highest bidder. I have one on order but I had hoped to find one sooner. Now my concern is that once my ordered Mav arrives, they'll sell it to someone who will pay over MSRP for it.

Part of the ordering verification process protects it, they can’t sell it to someone else without proving you denied/couldn’t take it for some reason. But yes, they could not honor MSRP which sucks.
